Calculating bank hols accrued over first half of year when on maternity leave

I have just come back from maternity leave, but have handed in my notice and will be leaving mid-June. Our holiday year is Jan-Dec and I work 3/5 days.

I am entitled to 7 days annual leave (3/5 x 25 days x 24/52 weeks). However, bank holidays seem a bit of a murkier issue.

My boss has made a pro rata calculation based on the annual figure of 9 bank holidays and come up with an equivalent total of 2.5 days (24/52 x (0.6 x 9) = 2.5). However, as 6 of the 9 bank holidays fall between Jan-June this changes things somewhat and would result in the equivalent of 3.6 days (0.6 x 6 = 3.6).

We are quibbling over 1 day, but I don't want to lose out on that day if I am entitled to it.

Who is right?

Hi

What is wording in your employment contract? Where I work, we don't make any payment for bh for leavers but the way we calculate bh for part timers is as follows:

Pro rata on the basis of days worked (9/5*3 = 5.4)

Then work out how many days the person benefits from i.e. Bh they are scheduled to work

Adjust holiday entitlement accordingly - may be negative

This is essentially what you have done so, unless your contract clarifies things, I would say you are right Smile
