Creating a new job and appointing someone without an interview

Is this ever okay? What about if it was a new part-time job that was needed in the department that was offered to me as I'm returning from maternity leave and requested part-time working. Wouldn't this disadvantage other working mums who might like the opportunity to apply for the job?

It depends what you mean by is it 'okay'. It's not specifically illegal, if that's what you mean - there's no legal requirement to advertise jobs internally. However although it's not illegal it's also not a particularly sensible idea for all sorts of reasons, including the reason you highlight yourself.

But if your employer doesn't have a 'advertise all vacancies internally' policy and wants to appoint you to a job without any kind of process, then (assuming you want the job) take it - the potential fall-out is their problem to worry about really.

But it's not being advertised at all. So there's no legal requirement to advertise internally, but is there a requirement to advertise? This is a large public company who should be following proper process.

No legal requirement to advertise, no. But if it's a large company I would be astonished if there is no policy around recruitment involving at the very least a requirement to advertise internally.

Some funding streams require advertising however as flowery says there's no legal requirement.

The senior management team have largely been appointed with no interviews or job advert
we have all been TUPE to the LA now and these staff are still in post
the LA is not aware that they were self appointed by the head of service
she is leaving as there are too many senior managers
in addition on senior manager who has been on sick leave repeatedly for years is working and setting up another business and this goes unchallenged
what ca I do should I whistle blow, they are likely to know it’s me
