I currently work for county council in library division on an ad hoc basis, so if they want me I work and get paid, if there is no work then obviously don't get paid, no benefits no pension etc. A job has come up for internal applicants only, do I qualify as an internal applicant?

I think you have to have a permanent contract to apply for internal vacancies

Do you have any option to refuse work? Is your tax and ni deducted by employer? I'm trying to work out if your employment status.

If you have employee status I don't think they will discriminate based on permant/fixed term contract. Too many potential indirect discrimination issues. If you're an employee then I think you're fine. If you're a worker probably fine too. If you're an agency worker or self-employed contractor then no, I don't think you can apply.

Why don't you ask HR?

Gosh apologies for numerous typos. Bloody iPhone!

if you have access to the internal vacancies listing - whether hard copy or electronic - I say advertise. In several private sector places I have worked, internal can include friends of people who work for the organisation.

I agree if you are employed by them it probably includes you but why not just ask HR/your manager what the definition of 'internal applicant' for the purposes of these ads is.

Medee · 04/03/2011 19:31

-advertise +apply

flowery · 04/03/2011 19:33

That's not a bad idea - you could just apply anyway as you have access. If it turns out you are not eligible, the worst they can do is turn you down but if they get a good application from you you never know, they may overlook that fact once it's in front of them.

fivegomadindorset · 04/03/2011 19:46

Katie, they pay my tax and NI but I don't have to work if they offer and I can't do it.

Yep your right should will apply and see what happens.

They can only say no.

Ok so you possibly don't have "employee" status but you're still a worker so I agree there's no harm in applying.

Good luck!
