Returned to work and temp has my role ?

Hi, not really that bothered about this, although Im not sure if it is the correct behaviour of the company.

I returned to work in January 2011 after approx 10 months maternity leave.

I know I was into my additional maternity leave and I dont have to be given the same role, but ;

When I returned to work, the person that was covering me is a TEMP and has remained in my role.
I have taken over the role of another colleague who has now gone on maternity leave. ( I already have experience of this role aswell )

What do you think ? Are they in the wrong atall ? Or is it all legit ?

I think you know that the answer is that they have followed the letter of the law.

Off the top of my head, it would seem to me that you know how to do both your current and previous role, whilst the temp only has experience of your previous role. Hence, from a business point of view, it seems pretty understandable why they have slotted you in where they have done.

Are you worried that you will be displaced if the person you've replaced comes back from maternity leave within the 6 months?

no basically I am in a bit of a boring role. In one way, im my own boss and have alot of free time, but it' not the job I came here to do 6 years ago. Plus there is no where for me to go in this role.

If I was in my previous role, i can move up.... if my boss was to leave and if they chose me.

I just wish they would have spoken to me, I started work and my boss wasnt even in.... my colleague had to tell me what i was going to be doing !

Yes I can see it was an easy option for my boss, but does that make it the correct one ?

Legally they are in the clear. However, given that you aren't happy I suggest you talk to your boss and establish what he/she intends to do long term. It may be that the intention is that you cover for your colleague's maternity leave and then return to your original job.

Okay, then in that case I would do what prh47 suggests and talk to your boss about plans longer term.

I would treat it as any other meeting with your boss about the future rather than anything to do with having just returned from mat leave, as that's just a distraction in this case, I think.
