Bank holidays and part time work

Can anyone help here. I work 2full days on a Mon/Tues and my holiday entitlement from May 2010 until end April 2011 is 4.5days plus bank holidays. The workers who work 5full days Mon-Fri have 20days plus bank holidays (28). It seems that my bank holidays are really deducted off my holiday entitlement and the full timers are added on. Am I right to think this is unfair?

You should be entitled to the same amount of leave as the full-timers, pro rata. And the same number of bank holidays, also pro rata. If you don't get this, then it's unfair, but it sounds like you do.

I assume that the bank holidays are added to your leave entitlement and you then have to book the days off when they come around. As you work Mondays, on which a disproportionate number of holidays fall, then this could put you at a disadvantage - assuming that your office is closed and you are unable to work.

In our office, we get around this by allowing part-timers to switch their non-working days during bank holiday weeks. That way, they still get their pro-rata entitlement to the bank holidays, and they get to choose when they take their leave as well. Could you ask your employer if this might be an option?

you should get 8 days holiday and 3.2 days bank holidays (11.2 total).

however, if your office is not open on a bank holiday monday and cannot be open then you are effectively forced to take your leave days on those days. this is totally legal i believe as your employer can tell you when to take holiday.

You could ask to swap some days (maybe work a weds instead) if it's causing problems with getting a family holiday but they don't have to say yes.

You need to forget about how it's worded and look at the actual amount of leave you are getting. Divvying it up by normal leave and bank holiday leave also makes it more likely to be confusing.

If full timers have a total of 28 days you should get a total of 2/5 of that. 28/5x2= 11.2 as fluffles says. Are you getting that?

By my calculation you are getting 7 days public holidays plus 4.5 days, a total of 11.5 days. So you are actually doing slightly better than the full time staff in terms of the amount of holidays. Unfortunately working Mondays and Tuesdays means that almost all bank holidays in the coming year are on your normal working days, so you are affected by them more than the full time staff.

Im in this position and I get 11 days - which covers my bh's. So in effect I get 3hol days all year and 8 paid bh's iykwim
Or I can take bh's with no pay

I'm in this position too. I used to benefit by getting 5 weeks a year holiday, plus most of the bank holidays (as they fell on a Monday)It worked out so I had 9 'weeks' (ie 2-day weeks) holiday a year. Now the company has changed to comply with 'EU regs' or some rubbish, so bank hols are part of my holiday pot. Boo!
