Do I have to advertise a job?

I've name changed for this and won't give too much detail as it may out me but I'll try and make it simple.

I need to fill job vacancy A and have identifed Miss X who can be promoted into this position.

If Miss X accepts this promotion that will leave her current job B vacant.

I can't identify anyone internally who could take on job B but I know someone professionally who I'd like to invite to apply for the job.

I'm sure that there is no legal requirement to advertise either of these positions but I need to cover myself and make sure that I'm not leaving my company open to any kind of discrimination claim.

Any advice?

No legal requirement to advertise, no. I would suggest you advertise internally to avoid any kind of problem internally, but once you've done that, you can appoint whoever you like externally without an advert if you don't need one.

I rarely advertise jobs as it costs quite a bot and they don't necessarily attract the kind of candidate I am looking for. I ask contacts in the industry and am sometimes sent CV's on spec.
