Impending redundancy- advice on how to proceed please

Sorry I needed to namechange, am a pretty regular poster.

I work for a small retail business (sole trader) and things have been declining for a while. We have a good working relationship but trade has been slower than anticipated.

I suggested cutting my hours as far back as September, but that was resisted until the end of November when I went from 31 hours down to 16.

Too little, too late and I received a month's notice on 6th Jan Sad

I've looked up my redundancy rights on Directgov and apparently am entitled to 3 weeks pay.

Based on what hours- my current, previous or a combination?

There's no mention of redundancy in my contract and holidays, sick pay etc are at statutory minimum rates.

Am acutely aware that they are just about managing to pay me and may not even realise that redundancy pay is due Confused

I need to broach this but would rather present correct info with links via email

Can anyone with (HR) knowledge help please?

A week's pay for redundancy purposes is based on your current salary, so the fact that you were on a higher salary until a couple of months ago doesn't matter I'm afraid.

This page on Directgov should give you/your employers everything they need to know in terms of calculating your redundancy pay.

I'd just write acknowledging your redundancy notice, saying that having looked into it you understand you are entitled to 3 weeks' redundancy pay, could they please confirm that you will receive this with your final salary payment.

I assume you are satisfied that the decision was fair?

The link is one I'd seen so I'll forward it. Doubt I'll get it all on my last day though, guess they'll try to just pay it over the next few paydays Confused

It wasn't a case of fair decision, more like only hope of survivalSad

The business may yet go under, cutting staff costs is the obvious option and the only other member of staff got their notice at the same time.

They've only been in post for a year so they don't get a penny?
