Employer not paying tax or nat insurance - my problem or theirs?

I've been working with a company for 3 months and have never had a payslip till now. I've got one now that covers one month, but it's not accurate, it says tax and national insurance have been taken off me but they haven't. This feels dodgy to me, but I don't know whether to kick up a fuss about it or just leave it. Won't they get into trouble for not paying, but I havn't done anything wrong so it won't come back on me, will it? I'm a bit clueless on tax and all that.

Phone your tax office and see if they are receiving it. You could get into trouble if they are not and end up owing a large tax bill.

Thanks. I will ring the tax office about it. But I know they aren't receiving it, no matter what it says on the payslip because I've had my full pay every month with nothign taken off me.
But why would they give me an incorrect payslip - who would that fool, if not me, and not the tax office? I guess thats what feels dodgy.

I know someone who had tax and NI taken off them for years but it was never paid to the tax office. It only showed up years later. He had kept every payslip he had ever got (thankfully) which showed he had paid the tax and the company had been keeping it.

send the tax office a photocopy of your wage slip, telling them what you have said here and ask them what you should do under these circumstances

KatieMiddleton · 25/01/2011 20:32

Have you told your employer the amount you're receiving is more than it should be?

I can't see any benefit for them of saying they're deducting tax and NI and giving it to you if you're happy to use PAYE.

Sounds like an error to me.

I believe employers have a legal duty for tax and NI and to provide you with a detailed payslip. Likewise, you have a responsibility to ensure it is paid, so contact your tax office and write to your employer.

Actually having thought about this a bit more I still think it's probably an error but I know as an employer (I have a nanny) I have to make sure her NI and tax is paid on time and that I am registered as her employer.

Still think speaking to employer in the first instance is sensible rather than faffing with tax office.

RibenaBerry · 26/01/2011 14:04

The employer is obliged to make the deduction so it is them that HMRC will come to in the first instance, but it's still your tax bill. And if they haven't been paying it across you won't be being credited for NI contributions either.

Take it up with them. Unless they are deeply dodgy and evading employer NICs, it sounds like a cock up to me.

SparkleSoiree · 26/01/2011 14:06

Your employer is legally obliged to send in tax and NI payments every quarter to HMRC. (Having recently learned!)

Thanks guys. I have rung the tax office, explained the whole thing and they said basically it's the employer's responsibility and if they dont pay what they should they'll get fined at the end of the tax year.
However, I didnt' ask them about national insurance..Confused
