Hello. Can anyone please direct me to a copy of the current TUPE Regulations on the web? I have been searching but can't find it for some reason.

Does anyone have any knowledge of the regs, particularly Reg 7.2?

Thanks!

I think this is the most up to date info but I could be wrong. What's the problem?

Thanks RamblingRosa, I did see that one but i discarded it for some reason - I'll have a proper look now.

My husband is about to finish with one company and TUPE across to the company who are taking over the contract. They have 'hinted' that they will make him redundant but are refusing to give him a definite answer. They now say that they want him to present himself at their offices on the first day where they will consult with him. If they are going to make him redundant should they not give him more notice than that? The dilemma is that he has been offered another job and is against a deadline to accept it, he can't wait until that date. Isn't there a rule that states they have to consult with him in good time? My feeling is that they are hoping he will be the one to back out so that they don't owe him any redundancy.

What makes him think they won't give the correct amount of notice?

PBGirl · 18/11/2010 12:29

I'm not referring to the normal notice period in his contract but the reasonable notice period that is required for the TUPE consultation. Sorry, not making much sense am I.

It sounded as though you and they were talking about consulting about redundancy, not about the actual company transferring across. Have they not consulted with employees about the transfer yet?

They have consulted a little with my husband. Initially because they were asking his advice on certain aspects of the contract (it's completely new to them). As soon as my H was slightly negative about some of their intentions (constructive criticism, not just moaning) they refused to contact him direct and have only had contact through his current employer since. They have said they are not 'likely' to continue his employment but refuse to give a definite answer until his first day with them. Surely if they have alread decided they should tell him? By the way, he is the only transferee.
