Sickness and returning to work.

Where would I stand if I had to leave my job after returning to work following a period of 8 months long term sickness.
I have began having serious headaches which have been diagnosed as Migraines probably brought on by stress.
My GP has a record of me visiting in December 2009 suffering from quite high anxiety. I was admitted to hospital for headaches at the beginning of the year which was the beginning of my sickness.

In October I was targeted by my manager and bullied. I reported this to HR and they dealt with the matter informally. He then proceeded to isolate me at work and made me feel very uncomfortable and unhappy in my role.

Another employee then made a report in December and this was investigated and they said they wanted to go down the route of a formal complaint. The manager was sent to work off site while they investigated and it resulted in him leaving the company.

My condition is not under control as of yet and I am trying various medications to help do this. I was contacted by work and asked to come in and have a chat and meet the new manager. I did this and have felt under pressure to return to work before I am fully fit.

I am now back at work and my medication will have side effects making it impossible to travel to and from work. I am one stage away from the final sickness staging if that makes sense.

It has been mentioned and hinted at on more than one occasion that I may have to leave or they will have to do what they have to do if I find I can't cope being back at work.

Where do I stand legally and does anyone have advice?

Sorry to hear that you have been unwell.

Have you been seen by Occupational Health, or your in-company health professionals, to be assessed as fit for work with/out any adjustments? Has the new manager asked for this to happen, if it has not?

Finally, have you visited the ACAS website for information? I'd suggest you do so while waiting for responses from other mumsnetters.

Will it? Have you tried? You sound like you've given up before you start!

What does your fit note say? What changes do you want to allow you to return to work?

I am scared that my medication will make it impossible and then i'll miss work. I have returned to work already so not given up before I've started and I am delaying my medication until the weekend.

I'm lookng for advice.

My fit note says that I will have to see how I get on and possibly reduce my hours - work have said this wouldn't be possible.

There is no occupational health as far as I know. I haven't been asked to see anyone.

Those two statements seem to contradict each other. Your doctor seems to think you will be able to travel at least some of the time, but you disagree?

Your employer should take advice from your fit note and if it's possible to make adjustments to allow you to carry on in your job, they should do so if they can. If your medication does make it impossible for you to travel to work, is yours the sort of job you could work from home?
