If I decide not to go back to work do I have to pay any of the money back?

Hi my maternity leave is coming to an end after xmas, and I am supposed to be returning to work part time. Hours/days are yet to be confirmed. Was just wondering if I decide not to go back, or go somewhere else - do I have to pay any of the money I have recieved on maternity leave back? A friend asked me this & I had no idea, also have hopefully had a better job offer so maybe wont return to original job

You shouldn't have to repay any statutory mat pay but if you received anything over and above that from your employer you may. You'll need to check your contract.

You need to check your contract. In many places, you will need to pay back all but SMP if you don't return to work for a certain length of time post-mat leave.

You would never have to pay back SMP but if your employer pays anything over and above it's pretty usual to have to pay all or some of the extra back. If that's the case, you should have been informed previously, ie it should either be in your contract, staff handbook, maternity policy or a letter detailing your maternity arrangements.

does any body know if we are entitled to any help if we do decide not to return to work? I have no idea what I can/can't claim besides child tax credits and family allowance.

Your partner might qualify for working tax credits genie, not sure. If you don't want to return to any kind of work you won't be able to claim JSA obviously.
