hiya,

i have recieved a vague e-mail which gives me the impression i am about to be made redundant.

my question is this:

if they tell me i have to apply for my own job ( or one similar to it) and i don't want to, am i still entitled to redundancy?

If you turn down suitable alternative employment without justification, then you COULD forfeit your right to redundancy.

On the other hand, if they were looking for volunteers for redundancy, you could always put yourself forward.

Sorry to hear this. I don't think you will be entitled if they say you have to apply. Your best bet is as chanie44 says and see if they want volunteers.

righto - thank you

Yes you would get it.

What normally happens is that you would be put into a 'pool' of people and a selection made on that. Its unlikely you wouldn't get your own job, unless there were more people than posts. In which case, they may accept a 'volunteer'.

HOwever, they are legally obliged to redploy you where possible.

If their method of redundancy selection is to invite applications for the available jobs and you choose not to apply for any of them, you will not be entitled to redundancy pay. However if you want redundancy and they want to make some redundancies ask them about voluntary redundancy.

If you do go through the application process for your job, don't get it and are not offered anything else suitable, then you will be entitled to redundancy.

I'm not sure, so don't quote me on this,I thought it may affect your entitlements to certain benefits if you you take voluntary redundancy. So just be aware.

eh Custy,you ok hun?

flowerybeanbag · 01/11/2010 20:24

Don't know about benefits, but if you have any kind of insurance against redundancy for your mortgage or whatever, that probably wouldn't pay out if you took voluntary redundancy.

Tortington · 01/11/2010 22:14

dont have benefits , or insurance -i'll get another job.

cheers mabs, am ok - part worried, part pleased
