Redeployment issues

Hello

I am due to be made redundant on Friday and was initially told five months ago. My employer seems very keen to ensure I have a new job to start next week (I think because I have claimed unfair dismissal). However, I have free accommodation with my my current job. A couple of other posts that have been suggested to me will be without such accommodation. After paying for rent and childcare I will be losing money. Can I refuse these jobs on the basis that I will not have the same benefits? Both jobs would also mean that I lose my management responsibilites. One is at the same grade but less hours, the other same hours but less money although the same salary would be honoured for a year.

Also, I was on ML when told about job but am currently on annual leave at the moment. I have been told that I have to fill in application forms (local government ones which take ages) and will be tested and interviewed. Is this standard procedure?

You can refuse the jobs for any reason you like. The only bearing is that if the position was deemed suitable and was offered as alternative employment then you'd lose the right to any redundancy pay.

Why do you think you have a claim for unfair dismissal?

What process did they following in selecting workers for the chop?

Thank you Seeyouokay. I have sent an e-mail refusing these positions and will wait and see what HR say now.

It has been a very, very long process. I was the only one made redundant after a restructure. My workload has not diminshed at all. Several other issues too.

I put in a grievance for unfair dismissal last week but the director decided it was all done fairly. I was told I was not put in a pool of the managers. I was the junior manager and therefore it was my job that went.

I have sought advice from a solicitor and he is discussing taking this case to an ET. I can appeal the grievance though which I am deciding on at the moment.

When you say your work hasn't diminished were there any other people doing the same work as you with the same job title etc?

Always work appealing. Generally with the courts its better if you can prove you've tried to sort it out before taking it to Small Claims (i.e. non employment stuff) or Employment Tribunal.
