I am temping for my old employer but would love to stay on permanently.

The job I am in at the moment has come around because:

The original girl was asked to cover another department which she did. She didn't like it so left - in that she handed a letter in and walked out the same day. Didn't answer calls or letters offering help.

When this girl moved department her replacement was found. She left last week so I got the call to cover.

Was hoping it would lead to something permanent but I have been told that the Directors need to have a meeting with the original girl because she left under dissicult circimstance - I assume the bosses are worred about constructive dismissal?

Under what circumstances would she not get her original job back?

Anyone know?

Your employer may offer her her job back if they feel she has a reasonable chance of a successful case. She may not want her job back and may be after some compensation. It's impossible to say really.

If you mean under what circumstances might or might not a tribunal order her to be reinstated, well if it goes as far as a tribunal hearing that will be months and it's unusual to reinstate people - it's normally about compensation.

But if you think there is a chance your employer may offer her the job back, that's up to them depending on the circumstances, and there's not a lot you can do about it really.

OK. Thanks. She does want her original job back and was quite vicious to me last week when she saw me here and told me.

I just feel a bit shat upon if I am honest and I feel that she's going to get her original job back regardless leaving me hungout to dry.

I just didn't know given the circumstances of her leaving that they could just tell her to bugger off and offer to me instead!

Well they could, if they think she doesn't have a case. If they think she does have a case and she wants to come back they may well offer that.

Sounds a bit odd, surely before leaving she could have asked to move back to her old job especially as you were temping. Shame doesn't look good for u.

No, the original girl left the firm 3-4 months ago. I have only been here a week covering for the girl who replaced her and who now too has subsequently left.

Just need to see if she has a case or not.

So, girl 1 moved departments and jacked in 3-4 months ago with no warning.

Girl 2 (girl 1's replacement) jacked in last week - also with no warning.

Girl 3 (me!) temping and covering for girl 2 until they work out what is happening between me and meeting with girl 1!

I suppose I just can't get my head round someone resigning from a post 3-4 months ago and then throwing a wobbly when her old role becomes vacant.

She only has 3 months to put in a claim for unfair/constructive dismissal, so assuming she hasn't actually put in any kind of claim yet, there will be no case to answer and it will just be whether your employer decide they want to reemploy her anyway.
