If I go back to my job, I will only make enough to pay the childminder... so its seems pointless right now, to work and make no money. However someone mentioned paying back my maternity pay.... I have no money at the moment so that would be impossible for me. Do I have to? how do I find out? Would I have to pay it ALL back?? Thats a lot of money!!!! Has anyone gone back just to avoid this, if so how long do I have to go back before resigning?

Paying back maternity pay usually only applies if you have an enhanced maternity package with your work, ie more than statutory.

It would only be the enhanced bityou would have to pay back.

There is usually a minimum period that you must return to work for in order to avoid paying it back (3 months at our company).

If your company only offers statutory maternity pay I don't think you would need to pay this back

pushme is right, it only applies to anything extra that you go. For example I got 6 months full pay before I went on to statutory. My place required me to go back for a month minimum to avoid paying back the difference between my salary and the statutory amount (about 6s 9d!)

There's another thread on this but it seems most people use their accrued annual leave in lieu of notice. Would that be possible for you?

yes SMP is yours to keep regardless but if they paid more than that ie. you were on 90% for longer than the 6 statutory weeks and they notified you in writing before you went on ML that this was conditional on your return to work for a specified period then the difference between what you received and SMP would be repayable. You would also need to remember to give the relevant notice period before you anticipated return date.

Not all employers would ask for maternity pay back - mine don't. Talk to HR at your particular work to find out the position.

I am on maternity leave until December and have applied for a job with another organisation and got an interview - do I need to mention that I'm on maternity leave?

If I am successful is there anything else I need to think about/be aware of?

Sorry didn't mean to post to this thread was supposed to be starting a new one...

My company policy is return for a year so worth checking x

flowerybeanbag · 09/09/2010 11:25

Jcee you don't need to mention that you are on maternity leave specifically, no. However if they are looking for someone to start more or less straightaway and you don't want to do that, obviously you need to let them know.
