Maternity / Redundancy

Hi, I am currenly on mat leave and recently wrote to work saying when I wanted to come back (before the 52 weeks). I was called to a meeting today and was told that my job role was no longer needed (I pressed the on this and they did use the word 'redundant'). They said they wanted me to do a new role in the organisation but that it would no longer be a manager role, it be a lower level and that it would be less money. They did not have a job description as they want me to input into it, nor did they have any idea of salary scale.

I asked about tasks I previously did that have been realloated to other (junior) staff while I was off and they said I should think about these and see if there were any of them that I wanted to do in the new role. No one was appointed to cover my mat leave.

AFAIK if you are offered an alternative role while on mat leave then it should not have substantially less terms and conditions than your current post?

It feels like they don't want to run the risk of making me redundant while on mat leave (the CEO phoned me after the meeting to reitereate I was not being made redunant) but want me to do the same job but for less money Hmm

Any advice??

It certainly does sound dodgy and my gut feeling is that they can't get away with this. Try calling the ACAS helpline on 08457 47 47 47 (Monday to Friday, 08:00-20:00 / Saturday, 09:00-13:00). They ought to be able to advise you.

They can make you redundant whilst on maternity leave - though they do have to follow proper selection procedures.
Sounds like they are making you redundant but are offering you another role - this is known as redeployment.

The alternative role must be at similar terms. Equality Human Rights: Redundancy, Maternity Leave

What I don't know is if the alternative work needs to be paid similar to your current job. It would need to have similar hours, similar location.

You need someone more knowledgeable than me.
You are not alone in this situation - another Mumsnetter (click for message thread) is in a similar situation. Skim reading that thread, I'm not sure there was any conclusion with regard to salary grade of the alternative job.

You need to bear in mind that over 6 months you come back into a similar job. Under 6 months mat leave you come back to the same job.
