Two questions about flexible working

I currently have an informal flexible working agreement, I come in early, leave early (ish) and work at home one day a week. I've been doing this since October. The company I work for is going a restructure, I was thinking about formalising the flexible working agreement. My boss has said she won't agree to it, but as I already work this arrangement, can this really be turned down as not meeting the needs of the business (or whatever the phrase is).

Secondly, are flexible working arrangements covered by TUPE, we had a long list of things that are and aren't and flexible working wasn't mentioned

I can't answer your 1st question, but can answer the 2nd.
Flexible working arrangements are covered by TUPE.
I went back to work part time after having DS, after arranging flexible working with my employer. My contract of employment was amended to show a permanent change of working hours from full time to part time.
About a year or so later, I was transferred under TUPE conditions to a different employer, and the terms & conditions of my employment stayed the same - i.e. same part time hours, same pay / benefits etc.

I'd try to get your flexible working arrangement formalised with HR asap if I were you.

I think you are right: your boss would find it difficult to turn down an arrangment if it has been operating successfully for some time.

On the second question, terms and conditions transfer under TUPE, practices don't. If you have been doing this for quite a while, it might have become a term and condition, and so transfer. Anything formal certainly would.
