I happen to be on a sub reddit about a sport - a perfectly civilised group (so it is possible, even on Reddit), then came across the Darlington nurses' decision, and was confronted with the full on circle jerk that is the trans ghetto.

What was hilarious was the number of whinges about the BBC coverage because it has always been so gender critical. Sorry, I fell about laughing.What BBC have these circle jerkers been watching?

Thank the lord the Workplace (Health, Safety and Welfare) Regulations 1992 were referenced so clearly.

IMO, supported by the Supreme Court decision on woman/man meaning biological sex, it sorts out this bullshit immediately (in workplace scenarios).

And even more ridiculous than the NHS didn't back down after the SC decision - or was this case held before that decision came out and it's taken this long to provide the judgment?

I applaud the nurses while simultaneously feeling utter contempt for a society where women have to bring legal action to have a women's changing room.

I'm also fascinated by their horror at possibly offending 'Rose' in the judgment by saying that some of his behaviours were disgusting and creepy he was just innocently following the permitted policy. Asking unknown women about their breast size or wearing holey underwear in public is NOT and never will be typical female behaviour, and that's before we even get near the fact he was allegedly trying to use his penis and sperm to impregnate his partner Hmm The wishes of this one large, tall and very obviously male individual were worth more than all the women making complaints because they simply wanted the law upheld.

yeah I think the reason Rose wasn’t deemed to have harassed anyone is because he was incorrectly told he could change there and the women had to be kind.
So it’s the fault of the NHS, not the male they wrongly sent into the women’s changing room.

Having gone through the 134 page judgement it is almost a complete victory.

The claims that failed were mostly very weak, with limited evidence including most of the claims featuring Rose's behaviour.

The one area where I think the tribunal was wrong was the claim of Rose repeatedly asking another nurse "are you getting changed yet". The logic seems to have been that there would have been nothing wrong with this coming from another woman, but they do not seem to have considered that it was coming from a male.

Otherwise it is comprehensive and readable and will be quoted often. HR lawyers will be having a very busy weekend.

As women, they don't have male genitals. Just as post op transwomen don't have female genitals. They have a facsimile of a penis/vulva-vagina that is in no way functional nor convincing.

I'll add here that many trans identified females haven't had ops or hormones.

When I was still in my permanent teaching post, we had three TIFs in the school at one time. (All three have reverted to their female identity since then.)

The one girl who was 'stealth' was excused P.E. and chose to use the disabled toilet. The other two girls happily used the girls' toilets and changing rooms. Their classmates had no problem with that all. Why should they? The TIFs were just girls who wore trousers and had short hair.

I wonder if they could sue the nurse's union for not doing the job of standing up for them. If a union sides with an employer who is breaking the law against a union member, WTF is the point of it? At the very least they should be able to get their subs back.

Thank fuck for common sense! Although they should not have been put through this in the first place. The organisation they work for is disgusting and the managers that supported this case against them should never be allowed to work in public service ever again.
