Likely to have major implication. Even if Dems win Presidency they will have serious issues in trying to get rid of human sexes again.

Big news 🚨

District court vacates Biden-era rule declaring that “sex” in Section 1557 of the ACA includes “gender identity.”

This rule and its antecedents in the Obama years mandated that healthcare providers offer “gender-affirming care.” 1/

🚨BREAKING: A federal court has struck down the Biden-era rule redefining “sex” in federal law to include “gender identity.”

The judge ruled that only Congress—not federal agencies—can change the meaning of “sex,” restoring its original biological definition under the Affordable Care Act.

This decision marks a major blow to the Biden administration’s effort to mandate “gender-affirming care” nationwide and a turning point in the legal fight over gender ideology in medicine.

Good, I hope this has an impact in the UK as well, most of the rhetoric coming from our gender addled omnicausers is straight from the USA, our dimwits can't even make up their own rubbish. The sooner the narrative from the USA changes the better.

Isn't this just Oklahoma:

The rule could have significantly impacted Oklahoma, which prohibits minors receiving puberty blockers, cross-sex hormones and irreversible surgeries as part of a gender transition. Drummond said this victory strengthens the state’s ban on gender transition procedures for children.

Federal courts are superior to state courts.

Federal courts are superior to state courts.

Yes but the quote specifically says could impact Oklahoma. If it has wider implications, ie for other states, wouldn't it reference that.

ie A federal court ruling in one district does not automatically set a precedent for other districts, although it may influence how other courts interpret the law.

IwantToRetire · 24/10/2025 01:00

Just to add I am of course glad at the ruling but was cautious in thinking it would have any impact country wide.

But if it encourages other States that would be great.

I’ve never watched any Joe rogan and only have a vague idea who he is but I believe he went on a full GC rant this week.

i understand he hadn’t before - is this more indication that the tide is turning ?

Floisme · 24/10/2025 07:14

I think Rogan’s been GC for a while but maybe he’s more open about it now

Here in Maine we still have holdouts who are in favour of allowing boys into girls' sports if they feel like girls. Our governor stood up to Trump over the issue, on the grounds that our state laws put the superintendents of school districts in charge of the issue rather than the governor. I think the impetus behind that is slowing down though.

Lots of states were involved in winning this. I just used one's state's release which focused mainly on the statewide implications I think the others hadn't dropped yet. The news was breaking at the time

This news report posted later explains ;

Federal judge sides with Mississippi, 14 other states in ruling against Biden-era attempt to broaden Title IX
By: Frank Corder - October 23, 2025

  • Biden’s Department of Health and Human Services tried to broaden Title IX to prohibit discrimination based on “sex stereotypes, sexual orientation, gender identity, and sex characteristics.”
U.S. District Court Judge Louis Guirola has ruled that the Biden-era Department of Health and Human Services exceeded its statutory authority when it interpreted Title IX to prohibit discrimination on the basis of gender identity and then implemented regulations concerning gender identity and “gender affirming care.” The lawsuit challenging the Biden administration Title IX rule change was filed in the U.S. District Court in the Southern District of Mississippi by a coalition of 15 states which included Mississippi, Tennessee, Alabama, Georgia, Indiana, Kansas, Kentucky, Louisiana, Nebraska, Ohio, Oklahoma, South Carolina, South Dakota, Virginia and West Virginia.... https://magnoliatribune.com/2025/10/23/federal-judge-sides-with-mississippi-14-other-states-in-ruling-against-biden-era-attempt-to-broaden-title-ix/

Wednesday’s final ruling in the matter drew praise from Mississippi Attorney General Lynn Fitch who has said the Biden-era HHS rule that would have coerced healthcare providers into providing sex-change procedures.
“The Biden administration attempted to import its radical theories on gender identity into ObamaCare, forcing healthcare providers to perform surgeries or prescribe drugs even if it violated their best medical judgment,” said Attorney General Fitch. “I am proud to stand with my colleagues from across the country as we fight to undo the Biden administration’s extremist political agenda.”
The court ordered universal vacatur, applying to all states, not just the plaintiff-states.

Along with the investigations for mass fraud against insurance companies over medical experiments on kids by the Federal Trade Commission which started earlier this year the gender industry in the US is in big trouble. It is NOT coming back from this. Because money was a big motivation for a lot of this stuff.

So does that mean at least 14 States have now got it confirmed that for legal, equality purposes sex means biology.

In which case, a postive step forward as it means about a third of States have that as law.

It says at the end

"The court ordered universal vacatur, applying to all states, not just the plaintiff-states."

I'm not sure what that means exactly but it sounds like it's going to be applicable to more that just Mississippi.

Guiroloa ruled that a statute “cannot be divorced from the circumstances existing at the time it was passed.”

The word “sex” is not defined in the statute, so the court said it must interpret the term according to its meaning in or around 1972, when the statute was enacted. At that time, the definition focused on the reproductive distinctions between males and females.

Guirola vacated the rule universally, meaning it’s not limited to the 15 red state plaintiffs. But the impact is likely limited because the rule had not taken effect.

https://thehill.com/policy/healthcare/5570411-judge-biden-trump-transgender-protections/

So this report suggests that rather than changing anything it will stop the Obama / Biden rule from coming into effect.
