NHS Fife tries to silence nurse - Sandie Peggie vs NHS Fife Health Board and Dr Beth Upton - thread #53

Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), has brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims are of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claims to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 February 2025 and was expected to last 2 weeks. However, after 2 weeks it was not complete and it adjourned part-heard. It resumed on 16 July and the last day of evidence was 29 July 2025. It resumed again over 1 to 2 September for closing submissions.

The hearing commenced with Sandie Peggie giving evidence. Dr Beth Upton gave evidence from Thursday 6 February to Wednesday 12 February 2025. Sandie Peggie returned to give more evidence on 29 July 2025.

Access to view the second part of the hearing remotely was obtainable by sending an email request to [email protected].

The GMC makes its own regulations under powers granted to it in the Medical Act 1983. The current regulations were made in 2015.

So the GMC's sloping shoulders "only obeying orders" is a worthless excuse.

I have a friend who works in HR for a large, well known arts organsation in London. Due to reorganisation, she was given the EDI remit and was inundated with staff suggesting new policies and practices for hiring more trans people and gay men.

She cause consternation by pointing out that both these groups were already over represented in their staff, and that the people who were significantly under represented were

women in senior roles
women from certain ethnic / cultural groups
people with with disabilities
people from working class backgrounds ( not a protected characteristic of course ) in skilled roles

You can imagine how well her evidemced based proposals were received ! They couldn’t take the remit away from her quick enough 😂

But lots of support for people "navigating changes to their gender identity"

My (NHS) workplace used to be so good at always being clear that they were non-partisan and would support staff on both sides when there have been previous conflicts.

e.g. Ukraine/Russia, Israel/Palestine, Pakistan/India - the medical director has been very good at showing awareness that they may have staff from both countries and with differering views. He'd put out a message acknowledging that it might be a difficult time for some people, and advising on support.

Until LWS and the Supreme Court. Since then it's been ALL about support for trans people, how upset they might be, how everything will be done to support them, here's a special network and support line.

And NOTHING about how women are affected. Nothing acknowledging all that women have been struggling with, nothing saying that services will be safer for women. Literally no mention of women at all.

It's been eye-opening, rage-inducing and depressing.

Thanks for the good wishes everyone. It's now occurred to me that before leaving home I didn't update my will to appoint an heir for the custodianship of this thread. Should the worst happen you'll have to fight among yourselves as to who will be lucky enough to take over.
