Doctors’ union votes for ‘identity-based care’ despite warning over lawfulness

The doctors’ union has voted for transgender patients to have “identity-based care” and called for this approach to be embedded into training.

But the British Medical Association (BMA) has been warned the move risks going against the law, after the Supreme Court ruling in April that the terms woman and sex in the 2010 Equality Act “refer to a biological woman and biological sex”.

At the BMA’s annual representative meeting in Liverpool on Wednesday, a majority of members voted in favour of a motion said to centre on “respect, safety and dignity” of LGBTQ+ doctors and patients.

It seems clear that the BMA haven't the wherewithal to carry out an analysis and criticism of the Cass Review. It seems that they have simply resorted to lies: "It's rubbish, that's it." and now, "We didn't promise to publish in January."

As if people haven't seen their statement and taken screen shots. They're becoming a laughable irrelevance; I hope the main membership can get together and get rid of the monomaniac activist dolts.

BMA motions literally carry no weight outside the meeting.

In the past they have voted to ban smoking, boxing, rugby and to end the conflict in Palestine. Totally pointless mutual backslapping, and one of many reasons I am not a member.

I didn't vote for this and I didn't vote for Dolphin to become the new council chair. The vast majority of members get no say in either of these as they're decided at a meeting that most people can't get to. At least I don't have to be embarrassed about being a member anymore as I've left, which is a shame as my local committee are pretty good, but I can't justify paying money for this kind of anti-science, sexist rubbish.

Do you remember when the arrogant twits of the BMA Resident Doctors Committee passed this motion (add your own joke):

“This meeting condemns the Supreme Court ruling defining the term ‘woman’ with respect to the Equality Act as being based on ‘biological sex’, which they refer to as a person who ‘was at birth of the female sex’, as reductive, trans and intersex-exclusionary and biologically nonsensical. We recognise as doctors that sex and gender are complex and multifaceted aspects of the human condition and attempting to impose a rigid binary has no basis in science or medicine while being actively harmful to transgender and gender diverse people. As such this meeting:
i) Reiterates the BMA's position on affirming the rights of transgender and non-binary individuals to live their lives with dignity, having their identity respected.
ii) Reminds the Supreme Court of the existence of intersex people and reaffirms their right to exist in the gender identity that matches their sense of self, regardless of whether this matches any identity assigned to them at birth.
iii) Condemns scientifically illiterate rulings from the Supreme Court, made without consulting relevant experts and stakeholders, that will cause real-world harm to the trans, non-binary and intersex communities in this country.

The main BMA has now passed another motion (add another joke) about being professional and respectful when criticising other institutions in response to the RDC making them look like idiots:

A BMA spokesperson said: "The BMA Council was recently asked to vote on a motion which said that, when the BMA criticises other institutions or bodies, it should do so in a professional manner and use appropriate language. The request that Council vote on this arose after the passing of a motion at the resident doctors’ conference which described the Supreme Court ruling on the legal definition of a woman as ‘scientifically illiterate.’ BMA Council members were asked to vote to resolve that: ‘All our patients should be treated with dignity and respect and if and when the BMA criticises other institutions or bodies, it should do so in a professional manner and using appropriate language. The recommendation has been approved and is now BMA policy."

The BMA passed another motion on "culture, inclusion and diversity" It says:

"Motion by LONDON REGIONAL COUNCIL: That this meeting calls on the BMA:-
i) to affirm the right of all LGBTQ+ patients and staff to identity-based care and working conditions - defined as care and policies that actively account for the individual’s lived, intersecting identities (including sexuality, gender, neurodivergence, race, and cultural background);
ii) to produce pan-UK guidance and a lobbying strategy to embed this principle into NHS equality standards, training frameworks, and institutional policies"

Responding, BMA representative body chair Dr Latifa Patel said: “This motion reflects the deep passion within the profession for delivering truly personalised care. The patients we care for every day have diverse and intersecting identities that affect their health risks, treatment outcomes, and overall quality of life. Providing care that recognises and responds to these differences isn’t optional - it’s the only effective way forward and the right thing to do.
“The BMA will call for clear, national guidance and a real lobbying strategy that enable doctors to deliver identity-informed care, so that no one is left behind. It’s important to note that the Supreme Court ruling made in April 2025 does not prevent healthcare that takes gender identity into account - this remains a vital part of how we care for our patients and for each other. When care considers a person’s intersecting identities where it’s clinically relevant, it leads to more personalised, fairer health outcomes and a better experience of the NHS and everyone benefits. But to do this well, doctors need the right training, policies, and support in place.”

There are probably a few ways to read it but when taken with their letter to NHS England in 2023 about the proposal that the NHS constitution uses biological sex instead of gender it probably means they still think nobody should have single sex care or single sex spaces (available via a link on this page www.bma.org.uk/advice-and-support/equality-and-diversity-guidance/lgbtplus-equality-in-medicine/lgbtqplus-equality-in-medicine )

"I am writing as the BMA’s Representative Body Chair and Equalities Lead to express our dismay at recently announced Government proposals to amend the NHS constitution. We disagree with the position the Government has taken and seek confirmation that the NHS will ensure that transgender patients can continue to access services that align with their identity …. The Health Secretary’s statements have been widely interpreted as a proposal to ban transgender women from admission to women’s hospital wards by amending the NHS constitution. If this is the case, the proposed changes to the NHS constitution are unworkable and likely unlawfully in breach of the Equality Act 2010, which prohibits discrimination on the grounds of gender reassignment …. I invite NHSE to meet with the BMA to discuss how it will ensure that transgender patients can continue to access services that align with their identity"

It sounds like the BMA still believe biology isn’t important and women shouldn’t be allowed single sex spaces, and now with Dolphin as Chair of Council I can't imagine science, rationality or respect for women will return anytime soon.
