Equality regulator engages Scottish Government and NHS Fife regarding staff access to single sex facilities

The EHRC have today written to NHS Fife and the Scottish Health Secretary about the requirement for single-sex facilities for employees. I quote: "We would like to remind you of your obligations under the Equality Act 2010. The Act protects individuals from discrimination and harassment on the basis of a protected characteristic, including sex, religion or belief, and gender reassignment."

But it's the Workplace Premises Regulations Act 2012, section 4 that applies. All workplaces and public buildings must provide single sex toilets and changing rooms - a man with no GRC doesn't have a leg to stand on (or even with a GRC, but Dr Upton doesn't have one). Women cannot be forced to change or go to the loo in front of men, however they dress or whatever cosmetic modifications they may have made, or be forced to be in the presence of undressed men.

Well this, widely reported at the start of the tribunal, has aged well!

It's understood that Sandie has already turned down an offer to settle. All the indications are that she wants this to go to a judgment.

While that is just rumour it makes perfect sense that NHS Fife would want to settle and shut the whole thing down.

Meanwhile Sandie Peggie who must have some strong backer, who's possibly been looking for a case that's a Stonewall Certainly to win and could easily become a landmark case. Sandies case has absolutely everything,

Wrongly suspended,
a Doctor who should in theory know the difference between male and female.
A level of arrogance thats off the scale.
Her impeccable long service.
Changing rooms.

While I'm assuming she must have a rich backer now, she must have had months of serious stress, prior to the Christmas Eve incident, then the suspension, lack of backing from the RCN.
I admire her so much.

NHS Fife offered to settle. Sandie clearly wanted this batshittery in the public eye.

And Oopse Dooopse😁, the public nature of the ET and lack of compliance makes this NHS branch an ideal test case. Once they produce the documents any failure found during the audit creates the framework for change and other bodies will have to adapt their policy.

Under the Public Sector Equality Duty, all Scottish health boards must assess how
(1) their policies and practices affect people with protected characteristics. We have requested that NHS Fife provide us with a copy of any
(2) equality impact assessment relating to the provision of changing facilities for staff;
(3) any information relevant to how such policies have been kept under review; and
(4) any details on steps taken to ensure that the rights of different groups are balanced in the application of these policies.

(1) Policy and pratices are the current and will not differ largely across the UK as an easy HR cheat is to pull other orgs policy and check ( the documents will be part of the board pack which is public etc)

(2) So is the missing EIA document is missing because nobody produced it? Likely and they have confirmed it

Oh dear that's going to be a massive problem for NHS Fife as they claimed in a foi response requesting the same info that it didn't exist and had no such policy as they were waiting on the NHS Scotland policy and its NHS Scotland who are responsible for risk assessing it and as such had done no risk assessments 🤣🤣🤣

(3) So that is a broad sweeping look back to 2004 when the law on Gender Reassignment and at any lobbying by Stonewall et al and any actual legal advice.

(4) polite FRO with your case-by-case policy but produce them and prove what you did.

Now if this is the EHRC's starting point the other NHS will not want to be held up to public criticism so the bright bunnies will be pulling their files together.

It looks as though the EHRC have taken the opportunity for a public fight, & likely win, very much on their terms which will also encourager les autres.

Management at NHS Fife is a disgrace. Carol Potter needs to get this under control.

They should be held accountable for the waste of money to the public purse. The thousands being spent on this could have been spent on improving facilities and patient care but oh no Fife decided they would crush a nurse with a 30 year career in defence of a doctor who was only 3 years into his career.

But only if they are a transrapist, otherwise they don't care. Or are female prisoners not human or worthy of consideration? It's not like the Scottish Government is unaware of this happening 😡
