Australian court rules lesbian group cant exclude trans women

... in his finding, Fenwick said the applicants identified as “a discrete minority within a group in the community that is already identified by their sex and sexual orientation, characteristics that afford them the protection of the SDA”.

“They seek to actively discriminate against another group in the community identifiable by their gender identity, a characteristic also protected under the SDA.

He said “endorsing overt acts of discrimination cannot be the intended effect” of exemptions within the act.

ie the ruling is saying that sex and gender identity are one and the same thing, rather than that each are a separate protected characteristic.

I don't think that's feasible, though - I'm imagining myself at a lesbian venue which I have chosen to go to precisely because I wanted to be with other lesbians, not necessarily with any er... romantic intentions, just to be with like-minded women.
It's pleasantly relaxing to be with people like you - I'm sure lots of you will have examples of enjoying being with other mums or other Welsh speakers or other Lego enthusiasts or whatever - not having to explain yourself is delightful.

The presence of people who do not belong to your 'group' - lovely though they might be - disrupts that relaxed atmosphere - you have to explain things, you may behave differently, you may be wondering why they have decided to turn up at all, lots of things that can 'kill the vibe'.

I know some lesbians don't mind men in their spaces - they are probably related to the women who don't mind transwomen in women's toilets 🙄but many feel
it is no longer a lesbian space if there are men in it.

And if they are creepy men who not only claim to be women, but also claim to be lesbians, I think their presence would have me and my friends heading for the door. Unfortunately, it would be to head home, because there would be no alternative women-only space left to go to instead, thanks to daft rulings like this.

just trying to think around this for Aussie lesbians. Not that i am smarter than anyone else.

as i understand it the state and its legal rulings can not interfere with private informal groups and gatherings of people going about their business.

So giggle as a formal entity can be dictated to but a private facebook group for example cannot, or a coffee morning or a secret meet in a bar.

top and bottom of it is lesbians in oz will have to go underground to keep men away.

what a lovely place to be not.

Don't think I misunderstood - you're asking how lesbians can legally meet up & keep men out. LAG have a private, members-only club, but they're not allowed to host public events advertised as for "lesbians born female" (or to turn away at the door men claiming to be lesbians). So they're saying they're already "underground" in a sense.

A pub for gay men got an exemption from the anti-discrimination law but the lesbian group didn't. Maybe there's some legal nitpicking that explains this but either way it's a misogynistic and lesbophobic double standard.

Women. The only group who doesn't get to define who's part of it. Remember the giant flap when Elizabeth Warren had the nerve to say she was part-Cherokee? It was backed up by a DNA test as far as biology goes. But that didn't mean a thing because only the Cherokee get to say who's Cherokee. As I recall, she wound up apologizing. But women? Half of humanity? Mr. Legal Beagle will tell us who we are. We couldn't possibly know.
