I'd like to know what exceptional circumstances the Government envision that would put a man who could be a sex offender and/or still has male genitalia in a woman's prison.

Jo Phoenix's thread is brilliant. The only riposte to it that I saw earlier today that I wondered how to counter was the tweeter who said that prostitution was counted as a sex offence but those offences weren't singled out among the transwomen prisoners.

I remember reading an article years and years ago, well before gender became the trendy cause du jour, that claimed men with trans identities were over represented in prison because of prostitution. I believed it then, it might even have been trueHmm. I don't believe it now. Do people even get jailed for soliciting in this country anymore. Unless there's something to aggravate the crime, in which case they'd be jailed for the aggravating offence.

As PPs indicate, money for sex services isn't illegal/criminal in the UK but there are some restrictions.

The exchange of sexual services for money is legal in the UK (apart from in Northern Ireland where it's illegal to pay for sex).
But, these related activities are illegal under the Sexual Offences Act 2003:

  • soliciting (trying to get clients) on the street or other public place, including someone in a vehicle
  • paying for the services of a sex worker who's forced or threatened into it
  • owning or managing a brothel (any premises which is used by more than one person for sex work)
  • pimping (someone who has control over sex workers and the money they earn)
  • advertising sexual services, including putting cards in phone boxes

For solicitation, I don't know about convictions and sentencing but, according to Statista:

There were 184 offences of soliciting for prostitution recorded in England and Wales in 2023/24, with the number in this year the fewest offences for this type of crime recorded in the provided time period. Compared with 2002/03 when there were 2,111 offences recorded, this type of crime has fallen substantially in recent years.

I think the implication of the tweet was that prostitution, although a sex offence, was not something that (to that tweeter) would imply a higher level of risk among transwomen prisoners as compared to non-trans male sex offenders. The obvious response is that all men are a higher level of risk to women than other women are, and transwomen are men, but I was wondering if there was a better response than that.

I certainly do not believe this to be the case nowadays and in the UK, but might still be true in other places, such as Puerto Rico, Brazil and other South American countries. In any case, as with the 'life expectancy one, these stats are not extrapolable
