Feminism: Sex and gender discussions

If only there were a quick and easy way for an athlete to prove their karyotype.

TooBigForMyBoots · 06/11/2024 15:27

I hope so @QAOPspaceman.

Snowypeaks · 06/11/2024 16:01

I think this is all performative. Iirc, the previous time he said he was suing, someone who claimed to know about French law said that this was a standard tactic to shut people up and rarely actually proceeded to a court case...? Anyway, I don't understand what the cause of action might be - even if it's harassment, if he is claiming to be a woman, then it's fair enough to discuss evidence he is a man, surely? Or it could be breach of privacy, I suppose, but ditto. And in one sense the information is already in the public domain. I mean, his chromosomes may not be obvious, but his sex is.

lcakethereforeIam · 06/11/2024 16:10

He should sue his dad. Donator of the Y chromosome.

KoalaCalledKevin · 06/11/2024 16:20

I imagine it would be over the publishing of medical records, rather than the contents of those records.

Helleofabore · 06/11/2024 16:32

The sleight of hand language being used is remarkable.

Khelif said after winning gold: “I am fully qualified to take part in this competition – I am a woman. I was born a woman, I’ve lived as a woman and I’ve competed as a woman. There’s no doubt that there are enemies of success and that gives my success a special taste because of these attacks.”

Yeah Khelif.... we know! Yet Khelif cannot say 'I am a female person with XX chromosomes' because that would be a direct falsehood. It is always the word 'woman'.

Yeah, but surely this has to lead to the test results coming out or an independent one being done

IANAL, but he could be thinking of suing for breach of confidential medical records?

If so the respondent simply points out that from several quarters, the info was already out there. The Olympic gyne doctor., his own coach, the IBA, etc etc

It is pointless to mention how little anyone wanted to discuss his inner and outer male characteristics, of course. All he needed to do was not cheat and none of this would have happened.

Aroastdinnerisnotahumanright · 06/11/2024 16:51

Didn't he already try this? I do like how the article avoids calling him a woman, at least.

She/ her pronouns all over the place though :-(

Wtfdude · 06/11/2024 16:57

The lawsuit will be about privacy of medical reports most likely.
Otherwise sHE would just take independent test 🤷

MarieDeGournay · 06/11/2024 17:01

Didn't the IBA decline to publish the result of the all-important test, on the basis that IK's medical records are confidential?
How uncharacteristically conscientious of them, especially as it would have been to their advantage to do so during the Olympics.

MarieDeGournay · 06/11/2024 17:02

ps one of the best thread titles ever, QAOPspaceman😂

IIRC it was a threat of legal proceedings if they did so??? I could be wrong. They definitely were notified before the Press conference that they were not permitted to disclose the records.

Wow! I read the same article a few minutes before this thread was started, he was only referred to as "the boxer" or "the Algerian."

Seems like they had complaints already and hurried added female pronouns. I wish I knew how to archive things 🤔

TheywontletmehavethenameIwant · 06/11/2024 17:08

He's suing JKR and Elon Musk (in France) for stirring up hate against him because they said he was male, now they have his medical records that say he's male, so bang goes his law suit. Maybe that's what he's upset about.

AmandaHoldensLips · 06/11/2024 17:10

I just hope with all my heart that the women who were forced to stand in a ring to get punched by a man will sue the arse off the official bodies who were responsible for facilitating them to be so violently assaulted by a man and robbed of their rightful prizes.

Yes, the IBA would have been wrong to publish the results because of confidentiality.

But following the IBA ban, Khelif had the right to appeal to the Court of Arbitration for Sport (CAS) and did so, but then withdrew the appeal. CAS decisions are made public, which how we know that Caster Semenya has male chromosomes. If Khelif had female chromosomes, what would be the problem with this information being made public?

Imane Khelif and Lin Yu-ting each won gold in boxing at Paris 2024 - but the row over their eligibility looks set to continue.

IANAL but if he sues for breach of medical record confidentiality then he's confirming that those are indeed his records.

so I bet he doesn't sue.

Yes, they needed the permission of both the boxers and their national federations to publish.

PrawnofthePatriarchy · 06/11/2024 17:16

Given what he has to hide I'll be interested to find the grounds he's using.

Yes, good point. And even if it is a breach of confidentiality, what is the damage he has suffered?

Same number of "she" and "her" in that version and the current version, so if there is an earlier version that is different it has not been caught.

Bowietips · 07/11/2024 13:44

Khalif will never actually go through with suing as doing so will reveal the truth. Threatening to sue is Khalif's attempt to deflect.

RoyalCorgi · 07/11/2024 14:22

I'm taking this with a massive pinch of salt. Is Khelif really suing Rowling and Musk for what they said about him (her)? I very much doubt that an Algerian, using the French courts, could successfully sue people based respectively in the UK and the US.

As for the new case, what on earth is he suing for, and who is he suing? Is he suing Reduxx for publishing private medical information and/or the leaker from the IOC who supplier the private medical information? Because if Khelif is acknowledging that private medical information has been published, then he is also acknowledging that the story is true.

Alternatively, if Khelif is insisting that he has XX chromosomes, then he must be suing for libel rather than breach of privacy. Good luck with that.
