I'm not a lawyer, but I've watched several of these tribunals. Today's hearing is different from past appeals because in effect Higgs' appeal has already been upheld and this hearing is intended to clarify the law. Perhaps because what's being debated are the finer points of difficult law, it's been difficult to have much idea of what's actually going on. If any lawyers out there could shed some light it would be much appreciated.
