So what counts as indecent exposure

2 unconnected stories

I was exposed to; man took his swimming trunks off in the swimming pool because they were “on the wrong way”….but because he “didn’t intend” to offend me, case was dropped and because of that loophole!
⬇️

The second is video of Emma interviewing police officers over a naturist event in a public park. Her X thread has graphic photos. It's excruciating to watch.

'A stranger flashed me in pool but police dropped case because of law loophole'

Emma-Jane Taylor, 50, was swimming at her local gym when she says a man got into her lane and dropped his swimming shorts while she swam towards him

Are you Emma-Jane? If so, I think you are amazing and I admire you hugely for all you have done. I'm sorry this happened to you. It's infuriating and shameful that this flasher got away with it. If it was the pool I think it might have been, the changing rooms are so close! He knew what he was doing, the perverted little shit.

No I'm not Emma- Jane, I agree with you she is amazing.

Did you watch the video of North Yorkshire police. They have no idea of what they're doing. And yes it's North Yorkshire police again.
It looks like indecent exposure is being decriminalised despite all the evidence eg Wayne Couzens.

I believe that to count as indecent exposure, it needs to be intended to be indecent. So to have a sexual element.

If it's not intended to be indecent, it would maybe be something more like public nudity?

Nah. Not buying it. If the man in the pool didn't want to flash anyone he would have found somewhere private to adjust himself.

Do you know any men who would take their swimming trunks off in the pool and not go back to a close by changing room unless there's an intention to expose and a sexual element? It's clear sexual harassment. Normal men don't do this.

There's also not a problem with wearing swimming trunks inside out. I wear my husbands old swimming trunks over my swimsuit and I've worn them inside out before and there is no problem.

Grim pervert and enabled by the police. I'd bet money on him doing something worse at some point. How many times do we need to see the red flags and the escalation?

I am not saying anything about the man in the pool.

I am saying what I understand the law to say about the principle.

It's always difficult with laws like this to prove the nature of the intent if there is no obvious sexual stuff going on.
