The Green party activist Eliana RUBASHKYN is accused of assaulting ThePosieParker and Tania Sturt at Albert park last year.

Rubashkyn changed his plea to GUILTY today and Linda Sutton was in court to follow proceedings.

Asked for a response Ms. Sturt said "I am unsurprised. I'm committed to completing the judicial process to hold Rubashkyn to account for his violent, misogynistic and inciteful act"

Over 14 months after committing the offence Eli Rubashkyn finally pleads guilty for assaulting ThePosieParker.

Will he get a discharge without conviction too?

I wanted to add this to the original threads but couldn’t find them, and I think this deserves a thread of its own.

Heres hoping for some justice for KJK.

Good news, although the man who punched an older woman in the face didn’t get any sort of punishment, so I can’t imagine this man will either.

FizzyLemons · 07/06/2024 21:24

I doubt there'll be any kind of meaningful punishment, but I was pleased he didn't manage to get the charges dismissed.

“The judge said it was not her place to take a political stance.
‘My task is not to consider whether Ms Keen is a bad person or stands for bad things or whether what the defendant did, if they committed the offence, is morally wrong…
I do not accept that protest and counter-protest should be expected to end in violence… People in this diverse and tolerant society when they go to protests should expect that they can protest peacefully.’”

Good. Does anyone know when he will be sentenced?

Datun · 07/06/2024 21:35

Good. And yes, lenient sentences are par.

But, as more and more of these violent men are pursued through the courts, the pattern becomes clearer.

Mad that the judge feels compelled to have to spell that out, as if violence can ever be justified if someone disagrees with a political view.

SinnerBoy · 07/06/2024 21:47

The off camera male interviewer said, "Rubashkyn was excused, but HE attended anyway..." "... HE would plead not guilty..."

Lots of "he," going on.

😃

Well said that sensible and fair-minded judge, by the way.

Good news. Watching that live was terrifying. And all for trying to say men can't be women...sigh.

Eli Rubashkyn, 35, whose legal name is Eliana Golberstein, faced two charges of assault after the incident on March 25 last year at the Albert Park band rotunda.
She [sic] pleaded guilty to the charges via her lawyer James Olsen during a brief appearance via audio-visual link before Judge Claire Ryan at the Auckland District Court on Friday.
Olsen asked Judge Ryan not to enter convictions on the two common assault charges and indicated he would be seeking a discharge without conviction.

The charges carry a maximum penalty of six months in prison or a $4000 fine.
Judge Ryan set a sentencing date of September 2 and remanded Golberstein at large ahead of sentencing.

Olsen argued there was no case to answer and insufficient evidence to establish intentional criminal offending to the level required to prove the assault charges. If convicted, Golberstein could face up to six months’ imprisonment and a $4000 fine.
Part of his argument was that there was a precedent not to lay charges in cases of political protest, such as when a woman threw a dildo at Steven Joyce seven years ago.
Police opposed the application.
Judge Ryan praised the quality of Olsen’s submissions as “advocacy of its highest standard” but found the police case against Golberstein was sufficient to go to trial.

(Wow, I’m actually shocked that the police also want this case pursued and then I’m shocked at my shock that the police are policing. Did the trans Teflon run out?)

Eliana Golberstein/Eli Rubashkyn is up on new charges!

https://nitter.poast.org/SimonRAnderson/status/1802943949994381336#m

Three weeks ago Eliana Rubashkyn plead guilty to assaulting ThePosieParker and Tania Sturt in Albert Park.

Yesterday he appeared at court to enter a plea in response to new charges. SimonTV attended the hearing.

https://nitter.poast.org/Chriscoveries/status/1802987244837576833#m

Background and Initial Charges:Rubashkyn gained notoriety after assaulting Kelly J King Mitchell (Posie Parker) and Tanya Sturt at a women's rights rally in Albert Park, 15 months ago. Simon describes it as "an act of premeditated political violence" which he captured on viral footage.
This act of political violence was celebrated in left-wing circles and by Green Party co-leader Chloe Warbrook, who said in a TV interview, "She has had the direct experience of the kind of rhetoric that we are talking about escalating into violence."

Media Coverage:Following the incident, Rubashkyn was featured in sympathetic media interviews by outlets like New Zealand's Stuff, Radio New Zealand, and Pink News in the UK. These appearances allowed Rubashkyn to "dine out on the worldwide notoriety he had gained from engaging in premeditated political violence."

Ongoing Behavior:Since the incident, Rubashkyn has continued to harass his victims online and has been seen defacing political hoardings in Auckland with a machete, posting videos of these acts on social media for his comrades to enjoy. Rubashkyn was quoted saying, "I got these stickers on like look sharp so it's not considered vandalism."

Plea and Sentencing:Rubashkyn initially maintained innocence but changed his plea to guilty for the assaults three weeks ago. He is due to be sentenced on September 2nd and plans to apply for a discharge without conviction. One of his victims, Tanya Sturt, "strenuously objects to a discharge."
Simon raises the question, "It will be very interesting to see if the police listen to the voice of the female victim of premeditated political violence and oppose the discharge without conviction application."

New Charges:Recently, Rubashkyn faced new charges of dangerous driving and assault with a blunt instrument, to which he pled not guilty. A judge-alone trial is scheduled for November 20th.
The defense plans to call an expert witness, understood to be a medical practitioner.

Media Restrictions:Simon applied to photograph Rubashkyn in court, but the judge declined due to technicalities around media accreditation. Simon notes, "Following numerous interviews and podcast appearances, Rubashkyn is suddenly a lot less willing to be photographed."
Simon is working to resolve these issues and expects future applications to be granted, stating, "In my estimation, Judge Simon Lance is a decent fellow committed to the concept of open justice."

What a surprise, violent and aggressive man is violent and aggressive. I don’t understand how the courts can’t see patterns of behaviour like this and take them seriously.

Same.

There are soo many of them. As I've said before, I can't think of a single TRA, or prominent transwoman who comes across as non-sexist or non-homophobic. At the very least.

(To me, obviously. Lest that be considered generalising).

Posie Parker assault: Activist Eli Rubashkyn who doused anti-trans campaigner in tomato juice convicted

•	Eli Rubashkyn was denied a discharge without conviction for assaulting Posie Parker with tomato juice
•	Judge Kirsten Lummis deemed the assault premeditated and serious, despite Rubashkyn’s remorse
•	Rubashkyn, also known as Eliana Golberstein, pleaded guilty to two assault charges in June

From the article

‘In sentencing Golberstein, she [Judge Lummis] pointed to the personal struggles she had faced as an intersex person, including being stabbed and shot at in her home country, as well as her volunteer work supporting gender-diverse organisations.
“You have become an advocate for the rainbow community... you are grateful for what New Zealand has offered you.”
Judge Lummis told the court Golberstein had been subjected to death threats following the assaults and she agreed with Olsen’s submission that she had already received enough punishment.
With this in mind, Judge Lummis chose not to impose a penalty, resulting in Golberstein receiving a conviction and discharge for her crimes.
The charges carry a maximum penalty of six months in prison or a $4000 fine.
“Don’t lose faith or hope from that decision, I know it’s not what you wanted,” she told Golberstein.
“I wish you the very best of luck on your continued journey from here.”’

So, a slap on the wrist even though the judge also noted (she pronouns used for Rubashkyn)

‘…the seriousness of the offending was elevated because it was a “well thought out premeditated assault” that she later justified to the media.
While Judge Lummis acknowledged Rubashkyn, whose legal name is Eliana Golberstein, was remorseful, she noted an apology was absent from her submissions to the court.’

What sex was the judge for the other activist who got away with no punishment?

I have no idea.

Judge sounds terribly unhappy at being forced to say that violence is wrong.

and off Eliana goes to offend again

SinnerBoy · 04/09/2024 15:28

Yes, he's effectively had a pass to do so. The judge made a real "poor old you" speech.

lcakethereforeIam · 04/09/2024 17:25

I know it's not what you wanted

I don't understand 😕 he got off scot-free. Did he want to go to jail?

WomanXXWorldsOriginsofMothersofAllNations · 04/09/2024 21:45

What she wanted was "discharge without conviction" so no accountability or acknowledgement of the fact that planning and carrying out an attack on two people for standing in a public space and speaking lawfully was wrong.

Then crowing to the media about it all, so I'd say not even remorseful (as I disagree with the judge here too).

As also noted by the judge - '...an apology was absent from her submissions to the court.’

Of course no mention of any kind of apology to the women actually attacked.
