Background and Initial Charges:Rubashkyn gained notoriety after assaulting Kelly J King Mitchell (Posie Parker) and Tanya Sturt at a women's rights rally in Albert Park, 15 months ago. Simon describes it as "an act of premeditated political violence" which he captured on viral footage.
This act of political violence was celebrated in left-wing circles and by Green Party co-leader Chloe Warbrook, who said in a TV interview, "She has had the direct experience of the kind of rhetoric that we are talking about escalating into violence."
Media Coverage:Following the incident, Rubashkyn was featured in sympathetic media interviews by outlets like New Zealand's Stuff, Radio New Zealand, and Pink News in the UK. These appearances allowed Rubashkyn to "dine out on the worldwide notoriety he had gained from engaging in premeditated political violence."
Ongoing Behavior:Since the incident, Rubashkyn has continued to harass his victims online and has been seen defacing political hoardings in Auckland with a machete, posting videos of these acts on social media for his comrades to enjoy. Rubashkyn was quoted saying, "I got these stickers on like look sharp so it's not considered vandalism."
Plea and Sentencing:Rubashkyn initially maintained innocence but changed his plea to guilty for the assaults three weeks ago. He is due to be sentenced on September 2nd and plans to apply for a discharge without conviction. One of his victims, Tanya Sturt, "strenuously objects to a discharge."
Simon raises the question, "It will be very interesting to see if the police listen to the voice of the female victim of premeditated political violence and oppose the discharge without conviction application."
New Charges:Recently, Rubashkyn faced new charges of dangerous driving and assault with a blunt instrument, to which he pled not guilty. A judge-alone trial is scheduled for November 20th.
The defense plans to call an expert witness, understood to be a medical practitioner.
Media Restrictions:Simon applied to photograph Rubashkyn in court, but the judge declined due to technicalities around media accreditation. Simon notes, "Following numerous interviews and podcast appearances, Rubashkyn is suddenly a lot less willing to be photographed."
Simon is working to resolve these issues and expects future applications to be granted, stating, "In my estimation, Judge Simon Lance is a decent fellow committed to the concept of open justice."
