Biden administration redefines sex discrimination in Title IX to include ‘gender identity’

President Joe Biden’s Department of Education issued new regulations on Friday, April 19, that prohibit discrimination based on a person’s “gender identity.”

The new rules, which will go into effect on Aug. 1, redefine the prohibition on sex discrimination for schools and education programs that receive federal funding — including K-12 schools and colleges and universities. Under the new interpretation of the Title IX protections, those rules now apply to any form of discrimination that is based on a person’s self-purported “gender identity.”

According to the executive summary of the Title IX revision, the changes are meant to “clarify that sex discrimination includes discrimination on the basis of sex stereotypes, sex characteristics, pregnancy or related conditions, sexual orientation, and gender identity.”

The summary further states that, except in certain situations, education institutions receiving federal funding cannot carry out “different treatment or separation on the basis of sex,” which includes a prohibition on any policy or practice that “prevents a person from participating in an education program or activity consistent with their gender identity.”

The new rules are set to take effect just a few months before the presidential election, and will apply to sex-based discrimination complaints filed on or after Aug. 1.

The rules will reverse Trump-era policies that critics say for years have bolstered the rights of people accused of sexual assault on school campuses. When Joe Biden was running for president, he described his predecessors’ Title IX regulations as a "green light to ignore sexual violence and strip survivors of their rights.”

Under the new policy, colleges will be allowed to use a lower standard to find someone guilty of sexual misconduct. The federal government will also raise its expectations of schools across the country by requiring them to quickly respond to all types of sex-based discrimination – not just to sexual harassment, which is the current threshold.

And colleges will do away with a controversial requirement for live hearings, including potentially traumatic cross-examinations between victims and those they accuse of sex-based misconduct.

Surprisingly, the very small Green party and the very small Communist party in my state is opposed to gender identity replacing sex in law.

Thanks Delphinium - that's really interesting and not the sort of detail that gets reported in the UK

Having 2 main parties seems the worst way of having "democratic" elections in any country.

It's not really reported here! You have to dig deep to find it in their meeting minutes.

Reem Alsalem, the UN Special Rapporteur on violence against women and girls, criticized the new regulations, saying that they "run contrary to the United States’ obligations under international human rights law."

“The erroneous redefinition of “sex” through these implementing regulations constitutes a grave setback that will increase the vulnerability of the majority of women and girls to incursions into their privacy, including voyeurism, sexual harassment and physical and sexual attacks, by effectively removing single sex spaces,” said Reem Alsalem, the UN Special Rapporteur on violence against women and girls.

Alsalem said the new regulations run contrary to the United States’ obligations under international human rights law to prohibit and prevent discrimination based on sex, which in its common meaning can only be taken to mean “biological sex.”

She said the regulations could also deviate from other international human rights obligations that the United States has towards safeguarding the rights of female students to privacy and their right to the highest standards of mental and physical health.

I completely agree with all the above comments. It is quite extraordinary that Biden has done this.

What I can’t see is how they haven’t thought longer term. If ‘Womens’ sport in USA, from grassroots upwards, has quantities of boys/men out performing the girls/women, than where does America think it’s going to get its world beating female athletes from? Their top performing athletes will be unable to represent them on the world stage, as so many sporting organisations are blocking opposite sex individuals as male performance levels are unfair.

The statement is insidious. On the surface you say, ok, gender whatnot is protected as is sexual orientation. Then you read it again and see it is a total attack on women's rights and women's programmes. Biden is a creep. How has the US ended up with two creeps standing for POTUS?

Regarding replacement of women with men, the TRAs are extreme. They are just ignoring the Wrongthink and they don't care about women's sport other than as a validation tool - that's my guess. Plus US sport is a big business and stage by itself.

But they may also hope to bully world sporting bodies into changing policy. Most of the sport governing bodies have left the door open to including men in the women's category in the future (ongoing appraisal of the science) and have left in place the wedge which helps force men in - the inclusion of male athletes with DSDs.

That's a good point about the economic and "soft power" benefits of the US having top athletes (for now). This really is a mess.
