Is this correct? I’ve looked at govt websites and cannot see Sex defined anywhere as this but there is a PSHE resource provider (for primary schools) who states this. It is the ‘gender identity’ part I’m questioning.

This is what the draft guidelines for schools about gender questioning children says about "gender identity"

Gender identity: is a contested belief. It is a sense a person may have of their own gender, whether male, female or another category such as non-binary. This may or may not be the same as their biological sex. Many people do not consider that they or others have a gender identity at all.

Gender identity is not a protected characteristic and "non binary" has no status whatsoever in law.

The following characteristics are protected characteristics—

  • age;
  • disability;
  • gender reassignment;
  • marriage and civil partnership;
  • pregnancy and maternity;
  • race;
  • religion or belief;
  • sex;
  • sexual orientation.

Copied directly from the Equality Act 2010. Gender identity is not covered although it is illegal to discriminate on the basis of gender reassignment, at any point in their transition. (Which you could therefore say covers gender identity if the person is transitioning.) It is not illegal to discriminate against a non-binary person as non-binary does not exist in law.

Personally, I'd say that slide is bollocks.
