The young man who assaulted an elderly woman at the Posie Parker event in Albert Park last year has been discharged without conviction, with permanent name suppression granted. This is not justice. The Courts should not silence Kiwis’ from speaking about crime committed against them, says Jonathan Ayling, Chief Executive of the Free Speech Union. “Little promotes the use of violence more than impunity. Violence in response to speech, even speech of the most offensive kind, must not be tolerated.

“Victims deserve to be able to share their story. Name suppression gags victims and is salt in a very raw wound. Tens of thousands of Kiwis signed the Free Speech Union’s public letter to the police following last year’s incident, claiming the police failed in their role. This latest insult adds to injury (literally). “The Free Speech Union is taking legal advice and considering appealing the decision to suppress Kiwis' right to speak about this crime.

“Late last year we saw two people wrongfully arrested for peacefully protesting. Now, here’s someone who has physically assaulted a 70-year-old grandmother, and they’re let off. It’s deeply concerning. “Not only should the defendant be punished, the victim should be able to speak. They should have been able to freely attend and listen at Albert Park in the first place.”'

Not only was this elderly woman attacked for no reason by a physically much more powerful, much younger man, but she was prevented form delivering the greater part of her victim statement.

Meanwhile, he gets barely a slap on the wrist and his reputation protected. (Though thanks to the wonders of the internet his identity has been revealed - there is another thread on this travesty - something like Hudnank Jack. He's only worth remembering if he tries to apply for a job where you are so you can throws applications straight into the bin.)

I'm the same age as the victim - her courage is incredible.

It's scary when the institutions of justice are ideologically captured.
If you can't impose a sentance on a bloke for punching a female senior citizen in the face then what's the point of having a justice system.

There's no way he should have got that sentence. But then the same happened here with Maria McLachlan and "Tara Wolf". Money knocked off the miserly fine because she "misgendered" and had "acted provocatively" after the event!

There's no way he'd have gone to prison in NZ. You can get home detention for attacking someone with a machete, or multiple rapes. Sentencing is a joke here. I'm often amazed by the length of sentences handed out in the UK.

She said a conviction would be out of proportion to his offending and would result in difficulty in the young man gaining employment.'

God forbid a violent man's life be impacted in any way by his actions.

I think the photo was probably taken as a screenshot of moving footage rather than a photo hence the slightly odd look.

Maybe, but as I pointed out, the exact same happened here in 2018 and the female victim was told off for "misgendering" by the judge.

We can encourage primary school kids to change their gender identity to something we don’t understand but we have to infantilise fully grown adult males who attack nannas. What a mess.
