For a first offence where he's deemed to pose no risk to the community (per the judges comments), I'm not surprised to be honest.

Fgs. The massive majority of us have many men in our lives who would never 'lose control' and sexually assault someone regardless of how they felt at the time. As Lundy Bancroft often tells the offenders he works with, (to paraphrase) you do not sexually assault or batter your boss when you're upset. You do not randomly batter anyone who annoys you. You choose your victims, and you choose when you do this behaviour. You are in control of it, and you do it when you choose and to whom you feel entitled.

I actually applied for this it be really reviewed by the AG under the unduly lenient sentence process. I believe it should have been an immediate custodial sentence. Unfortunately they didn't agree and he was not sent for resentencing.

How can a rapist police officer be deemed no risk to the community?

I think I’m right in saying that when a case like this goes to court, then the police have to wait for the outcome before they then take the officer to a tribunal. Obviously if they sacked someone before being found guilty that would lead to reinstatement/damages/tribunal. I assume the member of staff would be on paid leave?.
In this case he resigned, but the Devon Police still went through the disciplinary process, with the outcome being that he would have been sacked without notice, which couldn’t be enforced as he had already resigned.

Im not saying that the above is how the process should work.
I am also not sure what affect this has on pension etc. As I believe that Police Officers have been stripped of the state contributions of their pension previously.

There is another disgusting case in the first episode of this programme looking at police misconduct in Avon and Somerset Police. An officer on duty follows a drunk woman after she leaves a pub and offers to take her home in his car. He then rapes her in a secluded lay-by, and when she reports it a few days later, he claims it was she who sexually assaulted him! His testimony sounds like the ultimate dumb male porn fantasy in which a female stranger is immediately sexually available and gagging to jump on top of his willy (because he's so irresistible??). He claims due to previous PTSD from a car crash he is "frozen" while this drunk women he is meant to be taking home makes him stop the car and climbs onto him in the driver's seat. I can't remember if he is charged with rape but he is found not guilty of misconduct because the jury believes his side of events presumably (and unbelievably) and he is allowed early medical retirement with full pension.

It's absolutely chilling to think that all that woman did was get drunk and someone who was supposed to protect her took advantage of her instead with impunity. Women really are not free in public life if we can't even rely on the police not to rape us.

The so-called justice system is making it very clear that women are unimportant and male violence is acceptable. This is deeply disturbing.
