Abusive CPS Domestic Abuse guidance to be changed

Very relieved to say following the recent report about how the CPS domestic abuse guidance is biased against women and seeks to instead enforce the abuse, coerced speech, and coercive control of transwidows and children of transitioners, the government has announced it is to be amended.
The report is here:

I can't link to twitter but if you can, further info is available on Maureen O' Hara's twitter feed. Now we just have to wait and see what the new version looks like. ..

This is really important if the CPS management are finally starting to act and dragging guidance away from the dodgy employees putting out this stuff. But I can't see anything about it on Maureen's twitter feed?

Also on We are fair cop twitter feed I understand.

Is this the guidance that included 'not financially supporting transition' as abuse? If it is, then it's overdue a clear out. Should never have been written like that in the first place.

Chariothorses · 24/11/2023 15:59

Yes that's the one. Also said children sharing childhood photos would be committing an offence. Or elderly mums with a photo of their son on display before he started wearing a dress and stilettos. Or kids calling their dad 'dad' etc

This is great news, but insane it was ever policy in the first place

Froodwithatowel · 24/11/2023 16:26

Reading through the report, it is wall to wall plain fact and common sense well expressed, for example this:

in recent years self-declaration of ‘gender identity’ has been adopted as policy by the CPS and most key criminal justice institutions, such as the Police and Probation Services, and the courts. The adoption of gender identity theory by the CPS appears to have come about largely as the result of policy capture, as it is a widely contested set of beliefs which have been adopted without public scrutiny or approval. This suggests that policies may have been affected by “improper or undue pressure or influence”, contrary to the CPS Code.

And reading it pausing frequently to reflect how many drinks I owe the Trans Widows who have worked patiently and steadily to evidence and change things for other women having been so very badly treated and knocked down themselves, and also to Maya, who set in law that gender critical beliefs cannot be dismissed or treated less favourably.

That this sort of document is going through government now, this plainly expressed, gives much hope.

Froodwithatowel · 24/11/2023 16:32

Another gem:

The Organisation for Economic Co-operation and Development (OECD) has defined policy capture as, ‘‘…the process of consistently or repeatedly directing public policy decisions away from the public interest towards the interest of a specific interest group or person. Capture is the opposite of inclusive and fair policy-making, and always undermines core democratic values. The capture of public decisions can be achieved through a wide variety of illegal instruments, such as bribery, but also through legal channels, such as lobbying and financial support to political parties and political campaigns. Undue influence can also be exercised without the direct involvement of public decision-makers, by manipulating the information provided to them, or establishing close social or emotional ties with them.’’22 One way in which policy changes can be brought about without public scrutiny is through the provision of training and consultancy. Horrocks23has described the ways in which ‘experts’ who provide consultancy can use their influence to capture policy when they are perceived by the organisations who commission them as possessing very specialised forms of expertise which are not shared by staff within the commissioning organisations. Arguably this creates a power imbalance which facilitates policy capture by those perceived as experts, particularly where organisations seen as having expertise can confer awards on their client organisations. The CPS was previously a member of the Stonewall Diversity Champions programme

Bring on the inquiry. It's going to come.

Wow, that OECD definition of policy capture and undue influence is the literal Denton’s and Stonewall strategy 😳

Try the conclusion where the report pretty much calls for an inquiry and lists the matters at hand.

This is a fantastic document.

@Theeyeballsinthesky Thanks- I can't seem to access - is it registered users only or am I doing something wrong?

Will do 👍

It’s so heartening to see so many women tackling this fight from so many angles and with so many skills/talents. It really is something every woman can contribute to, not just those in public life. I’m not religious but I do compare it to the parable of The Widow’s Mite - every woman contributes according to her capacity.

Rightsraptor · 24/11/2023 18:44

The CPS has a new man at the helm, I believe. The former boss was Max Hill, who seems to have had some idiosyncratic views of the law, never mind ethics and morality.

It is a fantastic document, so damning of the CPS and so clearly sets out their (and other institutions/organisations) and their capture. It should be compulsory reading for ALL members of Government and publicly funded bodies.

This is brilliant 🥳🥳🥳
Thankyou everyone for sharing, and of course to everyone who helped to make this happen 💐

Croidia · 24/11/2023 19:44

I haven’t read but it sounds very positive from the extracts here. I would feel more positive if this wasn’t from a conservative think thank though. We badly need cross party consensus on this and I can’t see a path towards that.

MrsOvertonsWindow · 24/11/2023 19:50

Thank you OP - such good news. I wonder what happened to the sex by deception guidelines, also produced by the CPS that generated this comment from Sex Matters:
"The framing of the guidance seems to encourage people to try to get away with sex by deception, rather than making clear that it is irresponsible and abusive to deceive people into non-consensual sexual situations and relationships".
Again reinforcing the perception that the CPS allows people with some very undesirable views to use the CPS to attempt to force them on the public :

Excellent report. I've saved some of the wording for when I next fancy going head to head with the policy at work 😂

Croidia · 24/11/2023 20:58

Yes, that OECD definition of capture is very striking and resonates. Good to keep in the back pocket.
