Too vulnerable for prison

Late transitioning male, father of two, beats two intimate female partners. Escapes jail.

https://www.telegraph.co.uk/news/2023/10/17/transgender-woman-attacked-partners-too-vulnerable-prison/

It has been archived.

End of story, the wrong sex hormones nearly killed him. He obviously recovered. Seems like his true authentic self is a drunken, violent misogynist.

Transgender woman who attacked partners deemed too ‘vulnerable’ for prison

April Welsh, 37, handed a suspended sentence after drunkenly throttling one girlfriend and kicking another in the face

Sick isn't it? can we appeal? This is a violent man.
I am scunnered by the non justice for VAWAG.
@RethinkingLife
I knew I recognised that person somewhere! They popped up on a mad Corbyn fanatic TRA (female) thread when I was on facebook to abuse me and I recognised them from somewhere and thought they were the person with a history of violence fawned by Labour Lords! Couldn't remember their name! Now being fawned over by a horrible women hating Momentum Labour Lefty(sits on Labour Women's Exec). Best of buds etc.
As for that violent man in Wales, he can put all the makeup up he likez on but still a violent male. Oops I will be banned I bet. Having a bad day. Very triggering all this. Long time ago.

bombastix · 17/10/2023 19:10

Can't view the details but may be worth a referral to the AG's unduly lenient sentencing scheme.

catduckgoose · 17/10/2023 19:22

These men disgust me.

Madcats · 17/10/2023 19:22

How many women (adult human females) are in jail for murder/phusical assault versus

bombastix · 17/10/2023 19:24

There needs to be an end on suspending sentences for violence. It is wrong. Violent people inflict harm.

This isn't the first time its hapoened either for transgender offender.

bombastix · 17/10/2023 19:25

@catduckgoose - it matters what this person was charged with. You have to know what the conviction was to see if it fits within the scheme.

Madcats · 17/10/2023 19:26

Apologies (where has the "edit button" gone?)

How many women in women's jails need to be there because of violent crime (so they pose a danger to society)?

Subject to staffing, could they just tag the ladies and fill the cells with blokes?

bombastix · 17/10/2023 19:31

It should be the same test for women and men, passing the custody threshold.

But apparently there is a new test which applies to transgender women and they get their sentences suspended. What a soft touch this judge was

ATerrorofLeftovers · 17/10/2023 19:32

Very young women get sent to prison. Pregnant women get sent to prison. Men and women with severe mental health issues get sent to prison. Old men in their 80s get sent to prison.

The judicial system does not usually take much account of somebody’s vulnerability when deciding if a custodial sentence is necessary - it’s certainly not seen as a blanket barrier to imposing one in any other circumstance. So why is this male deemed too vulnerable to serve time in prison?

catduckgoose · 17/10/2023 19:43

Thanks @bombastix, I don't know if the sentence is eligible for review but I sent a request in anyway. Will update the thread if they respond!

bombastix · 17/10/2023 19:48

@catduckgoose - the lawyer will check it anyway but I think assault is not covered by the scheme. In my view it should be because beating your partner is domestic violence.

The vulnerability of an offender or not does not override repeat behaviour that should have been aggravated on sentence so that this charmer passed the custody threshold and then some and repeat conduct should mean no suspension in my view. Such a piss take with the law that applies here, truly.

'Too vulnerable' my arse.

'Sentencing, Judge Hywel James said: "This was a sustained attack on (the victim) and it's clear from the statements you had been drinking heavily that day.... On the door being opened, you attacked her with hands around her neck, pushed her to the floor and punched and kicked her. I have seen the photographs of her injuries and they show cuts, bruises and a swollen ear. Two months after this you were involved in a similar incident with another partner. That's a matter that has been dealt with but it shows a pattern of offending."'

Repeat domestic abuser punched and kicked partner after drinking heavily

April Welsh, 37, put her hands around her victim's neck and pushed her to the floor before assaulting her at her Blackwood home

😡Even those so ‘vulnerable’ they feel free to subject women to violent assaults…..

We women are having the piss royally ripped out of us by the establishment, aren’t we?

bombastix · 17/10/2023 20:00

ABH when drunk (aggravating) domestic violence (aggravating) and repeat conduct (aggravating) but trans so do not go to prison! Rubbish

https://www.walesonline.co.uk/news/wales-news/april-welsh-blackwood-court-sentenced-19955882

This was the offence he was previously convicted of, committed March 7th 2020, sentenced to 4 months suspended for 18 months, on March 3rd 2021. Just under a year between offence and sentencing.

His more recently convicted offence was committed January 3rd 2020, sentenced to 21 weeks suspended for 12 months, on October 16th 2023. More than 3 years and 10 months between offence and sentencing.

Does it mean that if the later court case had been heard like a year earlier than it was, the 18 month suspended sentence would have kicked in then?

Woman threw girlfriend against wall and kicked her in the face

April Welsh, 34, from Blackwood, committed the assault while serving a community order for a separate offence

https://www.walesonline.co.uk/news/wales-news/april-welsh-blackwood-court-sentenced-19955882

bombastix · 17/10/2023 20:16

Well spotted @catduckgoose that is correct.

IcakethereforeIam · 17/10/2023 20:24

Perhaps I missed it, but there's nothing in the Wales online article that says he's transgender, it reads like a woman committed the assaults.

He definitely seems to have benefitted from the appalling delays in the justice system.

Disgraceful.

NitroNine · 18/10/2023 09:54

Reminiscent of this.

Absolutely absurd. There are protocols in place for dealing with vulnerable prisoners. “Not sending them to prison”, much as that would delight eg paedophiles & those who murder children, is not on the list 🤨

I got an automated reply back from [email protected], pasting the interesting bits of it below.

Here's the detail of what they need from anyone who wants to request a sentence review:

If you are requesting that a sentence is reviewed under the ULS Scheme, the body of your email must include the following information:

· The name of the offender;

· The offence for which they were sentenced;

· The relevant Crown Court and date of sentence (if known);

· Whether you have a personal connection to the case, and what that connection is (if any); and

· Why you consider that the sentence appears to be unduly lenient.

Requests which do not contain the above information are not valid and will not be actioned. Links to news articles without the above information in the body of the email will not be accepted. If your email did not include this information, please provide it by way of a further email.

Please note that we have 28 days from the date of sentencing in which to consider a sentence. If the sentence was more than 28 days ago, there is no power to refer it to the Court of Appeal. If the sentence was for an offence that is not within the ULS Scheme, we won't be able to consider it. You can find out more about the ULS scheme on the GOV.UK website: https://www.gov.uk/ask-crown-court-sentence-review

Additionally, we can only consider sentences passed in a Crown Court (not a Magistrates’ Court or Youth Court).

They said they don't otherwise reply to individual emails but the outcome of case reviews can be checked on the government website:

The progress of all referrals made under the ULS Scheme can be tracked on the GOV.UK website: https://www.gov.uk/government/organisations/attorney-generals-office/about/statistics. We aim to update this page weekly.

I had a look, it's an Excel spreadsheet you can download which has a list of all the cases they were asked to look at and outcomes, in a redacted format.
