I'm in correspondence with an organisation about one of their policies, which lists 'Gender identity' as one of the protected characteristics, rather than 'gender reassignment'. Their response has been that 'gender identity' is more broadly understood, so that's what they are going to use.
I found the attached document and made a screenshot, but stupidly, didn't make a note of where it came from. It's a response by the EHRC to questions around gender identity v gender reassignment. I'd like to use it in my reply to the organisation, but really need a link and Google doesn't help. Can anyone help me find the source? TIA.

It doesn't matter what they believe. Gender identity is not a protected characteristic so if they write a policy based on their belief it won't be legal.
I would just send them a link to the Equality & Human Rights Web page that explains Gender reassignment.

I would perhaps mention Alison Bailey as an example of employers making incorrect interpretations of laws and being found legally accountable.

You need to make them understand that they don’t have the right to rewrite the law, or make up new versions of a law. How extraordinary that they don’t understand this already!

If they refuse to recognise the law as it stands, they will be breaking the law.

I'm annoyed its still being left to members of the public to 'make an organisation understand they may face consequences if they misrepresent or break the law.

Anyway, I couldn't find the quote but I did find these;

If they provide a single sex service which women could reasonably expect to be women only, and they open that service up to men who do not have a GRC, they are probably discriminating against women.

The Equality Act 2010 is an Act of Parliament. People and organisations simply cannot rewrite an Act of Parliament to suit their own ends, whatever those ends may be.

I'm a bit of a petrol head and own a sports car with a top speed of over twice the national speed limit and big fuck-off brakes. I've taken the advanced driving courses. Doesn't mean I can change the maximum national speed limit because I feel like it. It's a law and I must abide by it. Same thing.

Thanks all - I've now found the document in a Twitter post from Ian Thompson, who works with Stephen Nolan. I have already pointed out to the organisation concerned (and I think that you'd be surprised if I told you who it is) that when an organisation’s policies refer to the law, that organisation should use terms that are used in that law, and not terms that they think should be used. However, this seems to be falling on deaf ears, so wanted to use the EHRC document to reinforce my case.
