I have just had an email via Crowdjustice.

Raquel has lost her legal case against the Uni of Bristol

'The University was able to successfully argue that they do not owe a duty of care to students who, like me, face intimidation and violent threats from trans activist students and staff. The court found that in the enactment of their internal policies, the University did not act unlawfully.'

The judgement does, however

'confirms that I was indeed the victim of the “violent, threatening, intimidating behaviour or language” by trans activist students, and that, there was a “failure to respect the right of others to freedom of belief and speech,” '

I have the utmost admiration for Raquel and will gladly contribute to a fund should she be liable for costs

Yes. I would have thought Bristol University would want to rescue their reputation after the suicide scandal. Clearly they do not care. I hope lots of journalists write about this.

and I sincerely hope that Bristol university does the right thing and pays its own legal costs. Bristol university’s reputation is already in the gutter and needs no further damage.

Good grief, Raquel, you have absolutely nothing to apologise for - quite the reverse. As someone else said, you didn't lose, but we're failed by the system.

Bristol should be so ashamed.

This from Sarah Phillimore's piece caught my eye:

I think that had this case been bought earlier, it is unlikely that ‘AA’ would have been criticised in the way this Judge did. A big part of why ‘AA’ felt so empowered to act thuggishly can be found in the historic slow response of institutions to violence and intimidation offered by the ‘transgender community’.

Could the days of the 'sacred caste' be coming to an end? We can but hope.

I also was a bit disappointed to see 'apparent biological sex assigned at birth' used in the judgement. I find myself wondering how 'apparent' was intended to be interpreted in this case - and whether it is there as a nod to those born with DSDs or intending to be inclusive to those with a trans identity.

We all know who AA is and I don’t know why this person (who was also involved in the Kids Company scandal) was granted anonymity. Bristol seems to have given them a job in the law school so I feel for any poor person who has to be taught by them. Given their criminal record too, it’s outrageous that they have been given a job in a very competitive industry, whereas Raquel has more or less been forced off her PhD studies for nothing other than being a feminist. That seems to be the way the world works these days.

What a nightmare Raquel has lived through. I wish her all the strength in the world. I also do not regret donating and hope that she asks again if more costs are needed.

I would hope that the court would take pity on her and not award costs given that one party is a private individual subjected to horrendous bullying and the other is a huge university with a multi-million pound turnover.

How very illuminating this case and this judgement is. I agree with @GCandproud - do you know when costs will be decided? I'll keep chipping in because this matters so much.

Anonymity seems strange if a name were to be already in the public domain via, for example, a newspaper like The Bristol Post, and remaining unchallenged.

Was I too slow off the mark? Or is there another one that is still open?

Since my urge to donate to Raquel's cause was thwarted I took the advice to search for "Women Talk Back! Help Us Protect Single-Sex Services and Spaces!" and handed them the carrots. They've only got £16,565 of their £50,000 stretch target, and Bristol SU are fighting them by trying to strike out a number of their claims.

Shall remain clueless as to whether the person named in a bullying incident in the Bristol Post a while ago is the same person in this case or not. As above, seems odd to seek anonymity if it is, but otherwise it means there are more bullies threatening violence than I thought.

I also have three kids starting at university in the next few years. Mine will definitely not be going to Bristol and I will be telling everyone I know why.

That sounds like the original now closed fund. She had to set up a second crowd justice account because her solicitor moved firms. So there is another crowd justice with a target of £160 000. Its called "bullying and harrassment enabled by Bristol university.

That’s a rhetorical question because they do, that’s what they would do. And the idea that this person automatically regards any feminist academic as ‘unsafe’ unless they are ‘loudly and regularly pro-trans’. I mean it’s completely barking and so sexist.

It’s especially interesting because Dr Phoenix Andrews, formerly known as Penny Andrews, was personally involved in an episode of online bullying that led the victim to take his own life. Clearly a really unpleasant person through and through but one who feels buoyed by the ‘right side of history’ narrative that allows them to see their victims as less than human and consequently that bullying is okay. There are lots of people like that in academia, sadly. Raquel’s supervisors are in a minority but they are the ones who are decent people. Decent people don’t throw friends or colleagues to the wolves just because they disagree with them.
