Labour line on single sex spaces

Interesting piece by Ailbhe Rea in New Statesman includes this:

'Labour hadn’t always been clear about whether it supports the single-sex exemptions in the Equality Act. Now, whenever the controversial policy on Gender Recognition Act reforms comes up, Labour politicians emphasise that the legal power of places such as domestic abuse refuges to exclude trans women on a proportionate, case-by-case basis under the Equality Act would remain unchanged by Labour.'

I mean, obviously they really haven't been that clear about it. Probably because they're too busy weeping and muttering 'cervix' to themselves. But still, glad that's been cleared up...

Again, very disingenuous. When they say ‘case-by-case basis’, I think they mean something like ‘arbitrary basis, if the specific TW is deemed to present a specific risk’. In other words, is a violent criminal.

But the exceptions allow TW to be excluded even when they are very nice, if it is proportionate and in pursuit of a legitimate aim.

Hmm yeah. I don't know whether 'case by case' is Labour's language or has been interpolated by the journo. You could read it as a paraphrase of what the EA says (legitimate aim, proportionate means). Or it could be Labour obfuscation

I'm just pathetically grateful they are prepared to support single sex spaces at all tbh. Maybe Dodds should give one interview on this being R-E-A-L-L-Y clear and then they could all stop complaining that we're misunderstanding them.... she doesn't seem comfortable talking about this at all to me, I wonder if she hasn't fully been across the brief until now. I'm willing to bet she's been doing some reading up in the last week.

well, it looks like the EHRC has cleared it up for them so lets see what they make of that
hopefully it will give them the excuse they need to start talking common sense and then they can start concentrating on poverty, climate change, the war in Ukraine and getting rid of the bunch of lying bastards we have for a government.

Will they also make it illegal to deny funding where eg a rape centre doesn’t give access to transwomen? Also the problem with delegating down the decision is that no-one is willing to take it because of the backlash - see women’s sport at the moment. Will this suffice to reverse Annex B for example? The legal protections need to be clear.

Is the case by case judgement focussed solely on the trans woman, or do the needs of other service users come into play.

Say somewhere housing traumatised female Ukrainian refugees who had been the victims of rape/war crimes by Russian soldiers. And perfectly lovely trainwoman. Would the women be able to assert their need for a single sex space. Or a female prisoner faced with a trans woman cell mate. Or a frightened elderly female hospital patient with dementia?

We all desperately need a focused opposition (whatever our voting intentions!) to hold the government to account, push fresh ideas, to be a functioning opposition, at this very pivotal time in global and national events. Really need Labour to stop pissing about and do this.
