Is gender identity a protected characteristic? I was randomly reading the Ofsted report below.

files.ofsted.gov.uk/v1/file/50159857

Yes , gender identity could well be covered under that characteristic, as anyone is entitled to believe whatever they want and not face discrimination because of this belief. However, it also means that you are equally entitled to not believe in the existence of gender identity. Holding such a belief ,does not mean that you can expect people to see you in the same way that you perceive yourself.

Yes, 100% agree. If schools discuss gender identity they should make this clear.

It is, but not in the same law.

The EA2010 is one law..

The 'hate crime' bill is another.

This thread is about the ofsted report which is referring to the EA2010, so that's why I made the comment.

@334bu

*You are arguing over semantics. In reality, there is no difference, and it's just nit picking!*

So why change it from the term used in the Equality Act? Why was it not left as gender reassignment?

Gender identity is an ideology. Gender reassignment is a legal term. You wouldn’t change the protected characteristic of ‘disability’ to ‘feeling a bit poorly’ would you?

Gender identity is already covered as a 'religion or belief'. The other projected characteristics are factual.

GrownUpBeans · 28/06/2021 18:47

protected I mean!

Ofsted reports are quality assured before they are published. So this is not just a case of one inspector using the wrong term.

They added transphobic bullying to the things they look at quite some time ago.

It has taken Everyone’s Invited to wake them up to what any parent of daughters could tell them was rife in secondary schools , ie misogyny, sexual harassment and assault.

OK! I was only trying to clarify the different languages used, the terminology that can cause confusion.
