This person has breached their Sexual Harm Prevention Order on 'several occasions'.

District Judge Joanna Dickens said: “This is a really serious offence. It is thought, quite rightly, that you present a danger to children. The danger is, you will ruin people’s lives.

“It’s [the SHPO] not been made to punish you, really it’s been made to protect other people.

...

“I’m not going to send you to prison today, and the reason for that is because you have very very complicated issues. You’re currently undergoing gender reassignment… I would be very concerned about your safety.

“You are very very very vulnerable. That’s the only reason I am not sending you to prison. If you were not vunrable, I would probably send you to prison.

“Other people are made vulnerable by you. You have got to stop this offencing. You need to know if you commit and more offences, you will go to prison.

This bit is taking the absolute piss. Blood pressure tablets or stress balls at the ready if you haven't needed them yet...

“If I am in this court again, and you commit further offences, I won’t want to, but I will send you to prison.”

If you commit further offences (bearing in mind this is a child rapist ) I won't want to send you to prison, but I will...

What the actual fuck?! Angry This is beyond a joke. This is fucking disgraceful, it's sick.

The poor actual victim in all of this :( I hope they're being supported.

I find it interesting that they changed their name to a very bland one that I'd guess is very common and also is gender neutral.

I agree that there are plenty of prisoners who are at risk especially in the male estate and that needs addressing.

So he raped a little boy when he was 12 and since then has repeatedly downloaded child rape materials and tried to contact children for the lat 16 years. Why does the judge think he's going to stop now?

Or is him being beaten up in prison worse than him abusing more children? Confused

"Thousands of sex offenders could be working with children because they have changed their names by deed poll to escape detection, according to a hard-hitting new report by former Home Secretary Sajid Javid." (continues)

Alarmingly, the report says at least 900 convicted sex offenders – and possibly thousands – could be operating in jobs that bring them into contact with young people because they have taken the simple expedient of paying £15 to change their names by deed poll.

At no stage is an applicant required to disclose their criminal history – which the report recommends should change.

It says the current stipulation that those on the sex offenders register must tell the police if they change their names within three days of doing so ‘is essentially an honours system with the onus on the individual to keep the police up to date… over 900 offenders may have changed their names without notifying the police and are now living under the radar’

The report adds that as the 900 offenders ‘only represent data released by 16 of the 43 police forces’ then ‘it is likely then that the actual figure is far higher and thousands of registered sex offenders are off the radar.

‘The worst-case scenario outcome is not unfeasible: that some of this number have acquired fresh names and are working or living alongside children. We must locate these individuals and safeguard children they may have access to. We recommend the Home Office commissions an urgent inquiry into this matter.’ (continues)

In appears inevitable that some convicted male sexual offenders will change not only their name, but the sex marker on passport / driving licence and even their birth certificate (via GRC).

Yes, the sentence needs to be reviewed; the only thing the judge left out was a little speech about "you leave here without a stain on your character" and bunging the guilty party fifty quid out of public funds "to tide you over". Offering a shakedown in her spare room for a few nights would have been nice...
I take it from the Court's leniency that social-distancing rules weren't flouted?

Surely this will be reviewed. Had there ever been a case like this before? I seriously hope not. I hope this is one rare miscarriage of justice.

Missed this at the time. It’s a response to the petition about name changing from Jan 21.
Apparently it is the second version.
We understand concern about offenders attempting to hide their identity and are working with Courts and Disclosure and Barring Service to close any monitoring gaps to ensure the public is kept safe.

Protecting the public from sexual and violent offenders who pose a risk of serious harm is a key priority for the Government and the police. The Government is recruiting 20,000 more police officers and creating extra prison places to ensure violent and sexual offenders spend longer behind bars.

There is no current legal process to start using a new name. But a person who has changed their name might need a ‘deed poll’ to apply for or to change official documents like a passport or driving licence. A deed poll is a legal document that proves a change of name. ‘Enrolling’ a deed poll means that you’re putting your new name on public record. You must apply to the Royal Courts of Justice to get an ‘enrolled’ deed poll using the deed poll process. It costs £36.

In 2015, the Home Office published its Use and Change of Name Guidance (www.gov.uk/government/publications/change-of-name-guidance/use-and-change-of-names) on GOV.UK. It sets out the policy to make it more difficult for people to change their identities to enable them to commit crime, and to ensure there is a consistent approach to handling applications to change names contained on official documents.

This policy aligns the various approaches to managing name changes for Home Office documents such as British passports, Home Office Travel Documents, biometric residence permits and other forms of immigration documentation.

As Minister for Safeguarding, Victoria Atkins MP has written to the Master of Rolls and the Royal Courts of Justice requesting that a Judicial Working Group should consider criminality in regard to the enrolled deed poll process.

Once we have done so through the Judicial Working Group, we intend to also amend our existing Home Office guidance so that only enrolled deed polls (through the Royal Courts of Justice) are accepted as a proof of name change. We have also written to the Disclosure and Barring Service (DBS) to recommend that they undertake a feasibility study to determine the impact of requiring those seeking a DBS certificate to present a birth certificate alongside other primary and trusted Government documents.

Registered sex offenders are currently managed by the police. Tough checks and a range of legislative measures are available to the police to manage known sex offenders living in the community. Local police are in the best position to identify the risk posed by individuals.

Across the country, there are nearly 1,000 police officers who are dedicated full time to the management of sex offenders. These officers do not work in isolation. In a local area, all other police officers and PCSOs know who the relevant offenders are, and contribute towards their management in the course of their day-to-day policing duties.

The failure of a sex offender to tell police of a name change within three days is a criminal offence, with a maximum prison sentence of five years, and the Home Office already reserves the right not to issue a document in a new name to a registered sex offender.

Sex offenders have a duty under the law to notify the police when they change their name as part of their notification requirements. Offenders who attempt to hide a name change already face tough sentences. Where the police are notified that a sex offender has changed their name, the offender’s records will be updated on the Violent and Sex Offenders Register (also known as the ‘Sex Offenders Register’) and the Police National Computer. Her Majesty’s Passport Office (HMPO) relies on police forces to notify them of registered sex offenders so they can be flagged on HMPO systems.

If a sex offender then applies for a passport under a new name, HMPO will consider the application in consultation with the supervising police force. If the police have no objections and there are no other reasons to refuse, then the application will be granted and the new passport details provided to the supervising police force. HMPO requires anyone changing their name to be using that name for all purposes.

The Disclosure and Barring Service (DBS) plays a vital role in ensuring employers have the right information to help protect those in their care and prevent unsuitable people from working closely with them. ID guidelines for the DBS checks state that employers must ensure the applicant declares all previous name changes, and provides documentary proof to support the change of name. If the applicant is unable to provide proof to support the change of name for the check, it is for the employer to hold a probing discussion with the applicant about the reasons why before considering validating their identity.

Any decision not to issue a document will depend upon the purpose for the change of name, the nature of the offence committed and whether the change of name may be used to perpetrate further offending.

We will not allow sex offenders to evade justice and engage in criminality by attempting to change their identity

This is why I asked, on another thread, about something I'd read a few years ago about the opportunistic transitioning of male offenders, and especially male sex offenders.

Dr. James Barrett, President of the British Association of Gender Identity Specialists, in his evidence to the Parliamentary Transgender Equality Inquiry in 2015.

The converse is the ever-increasing tide of referrals of patients in prison serving long or indeterminate sentences for serious sexual offences. These vastly outnumber the number of prisoners incarcerated for more ordinary, non-sexual, offences. It has been rather naïvely suggested that nobody would seek to pretend transsexual status in prison if this were not actually the case. There are, to those of us who actually interview the prisoners, in fact very many reasons why people might pretend this. These vary from the opportunity to have trips out of prison through to a desire for a transfer to the female estate (to the same prison as a co-defendant) through to the idea that a parole board will perceive somebody who is female as being less dangerous through to a [false] belief that hormone treatment will actually render one less dangerous through to wanting a special or protected status within the prison system and even (in one very well evidenced case that a highly concerned Prison Governor brought particularly to my attention) a plethora of prison intelligence information suggesting that the driving force was a desire to make subsequent sexual offending very much easier, females being generally perceived as low risk in this regard. I am sure that the Governor concerned would be happy to talk about this.
