I'm very annoyed. Surely money from Government benefits/welfare payments could have supported his family?? This should not be a reason to avoid jail. :(

Miah then fled the scene only when the unnamed woman, whose identity is protected by law, used the SOS function on her iPhone to call 999.

This made her phone let out a loud beeping noise to alert anyone nearby while contacting emergency services.

"Since the assault, I have not been able to leave the house or work," the victim told police.

"I do not know if he knows my route to work. I am scared to walk anywhere.

"I will have to rely on my friends or family to drive me to work out of fear."

Miah, of Lees Street in Shaw, Oldham, ran off but was soon arrested.

The 23-year-old faced jail after admitting sexual assault but was sent on a sex offender rehabilitation programme after pleading he was a ''the sole earner'' in his family, the MEN reports.

Appearing at Tameside Magistrates' Court last Monday (March 8), his lawyer said the attack was ''quite opportunistic".

It took place at around 9pm on December 11, 2018, in Oldham after the woman was on her way home after finishing at work.

Prosecutor Peter Conroy said: '''She noticed there was a male walking behind her, and he bumped into her.

"Her right shoulder hurt and she lost her breath because of fear that she did not know what the defendant was going to do. "

Miah asked her what the time was, Mr Conroy said, to which she replied.

But he continue to follow her for around another 60 seconds before approaching her and grabbing her buttocks.

Mr Conroy added: “She was shocked and frightened. She told him it was not right for him to do this. He had his arms around her chest and then the next thing she knew, she was on the floor on top of him.

"He lifted his right hand towards her crotch and started to move her hand up towards her chest.

“She said ‘my mind froze, I was in total shock’. She managed to get out her mobile phone and use the SOS function to call 999. This let out a loud beeping sound and this forced him to instantly let go and run away down an alleyway. She had said nothing to him to warrant giving him any right of doing this.''

Miah, who gave no comment in his police interview, was the sole earner in his family, his lawyer Saul Comish said.

"He is in employment at a takeaway where he works from 4 to 11pm," Mr Comish said.

"He is married and is a father to a four-year-old child. If you feel a custodial sentence is required, he would lose his job and he the sole earner for his family, so this would have a significant impact.

"This incident was entirely out of character. He has a low risk of re-offending."

Miah was sentenced to six months imprisonment, suspended for two years and will have to complete 250 hours of unpaid work.

He was also ordered to pay £213 in costs and sign the Sex Offender Register for seven years.

Sentencing JP David Quarnby said: “This was a cowardly and sustained attack on a young woman late at night.''"

And I don't give a friggin crap that it was apparently "out of character" . Don't believe that either.

Nothing is going to change at Magistrate’s court level AS THEY ARENT BLOODY LEGALLY TRAINED. So any ding-dong can become one, and I’m guessing (as I don’t have time right now to google) the people applying are either upper middle class white and some similar women. So very socially conservative views.
Will start a different thread.

Isn't there a way for memebers of the public to appeal a lenient sentence?
I know I've done so several times before, but not sure if it only applies to certain cases.

It’s a fucking disgrace.

And it’s made even worse by the fact that the poor woman waited two years for that pitiful sentence. Even before covid the courts were shockingly underfunded and delays the norm.

This is truly disgusting and frightening.

The judge should hang their head in shame.

This man preyed on her, followed her in the dark, frightened her, physiclly grappled with her, went in for a second go and physically put her to the ground and sexually assaulted her. He was quite calculated in following her and getting her.
She was saved from him taking this further because of her sos phone alarm.
No custodial sentence? Because he works and has a child. This man is frightening and I pray every one in the local are boycotts the takeaway.
Does anyone know what takeaway iris he works in because I am going to contact them.

The system is against us. This must change.

Social services will now have to an assessment as a sex offender has contact with a child. I pray social services decide he cannot reside in the home with the child.

It's absolutely mind boggling to think that it can be asserted with a straight face that a man who attacks a woman is previously of good character and that argument be taken seriously for sentencing.

Why isn't the fact that he attacked the poor woman not taken as proof that his character is bad vs some unproven good character statement that basically means it's the first time he's been caught?!

Yes I have to say the magistrate system in the U.K. seems to be grounded in the Middle Ages. I went to the magistrates court years ago with a friend who had been charged with a minor drug offence and It was clear the magistrate didn't understand very much about what my friend had been charged with at all. It was quite embarrassing

I wonder if there is a system of sentencing reviews that we can get MPs to sign up to. The current sentences don’t seem much of a deterrent.

I really home the collective wisdom here can find some way to make improvements. I was scrolling through Twitter yesterday and noticed several new campaigns to make victims aware of new ways to surreptitiously summon help if they’re in danger (hand signals , the pharmacy ask for Ani campaign etc) . All well and good, but really, the work needs to be done to ensure once a woman is brave enough to speak out, the framework is there to ensure her safe future. No use reporting a man for domestic violence/ sexual assault/ stalking if that report only means an even angrier man released without charge , and wanting revenge.
