Demonic possession

Man cleared of assault after claiming 'poltergeist' caused injuries www.dailymail.co.uk/news/article-8953995/Irish-man-cleared-assault-claiming-partners-injuries-caused-poltergeist-activity.html?ito=native_share_article-masthead

Apologies for the Daily Fail link.

A man appears in court charged with assaulting his female partner. His defence is that the injuries were caused through demonic possession - and the judge accepts that.

Is this the new "rough sex" defence?

Could well be. Don’t apologise for a DM link. On many occasions they’ve been really on the ball with women’s rights.

It's hard to make head or tail of that report . Presumably either he injured her, or she injured herself - in which case she needs proper help not this 'exorcism' and presumably unqualified 'healer' nonsense.

The Mail reports crimes affecting women and children which never see the light of day elsewhere.

The btl comments on the article are very fair- ranging from self- harm carried out when he wasn't there to not believing his story that he didn't hit her but in either case expressing concern about what's being done for her mental health.

Yes, that's a point which the much maligned Daily Mail readers picked up on although apparently no one involved did.
Goosefoot · 17/11/2020 00:19

Weird.

Though as far as I can see the real reason they acquitted him was they did't have real evidence he was the cause, which is a different kettle of fish.

alexdgr8 · 17/11/2020 00:26

yes, remember the burden of proof is beyond all reasonable doubt in a criminal case.
so unless the prosecution can prove the offence happened and was committed by the defendant, beyond a reasonable doubt, then the court has to acquit.
the defendant does not have to prove that he did not do it.
presumption of innocence applies.
so perhaps the prosecution did not put enough clear-cut evidence before the court.
agree, on the face of it, it sounds bizarre.

EmmaGrundyForPM · 17/11/2020 02:02

Yes, I did think maybe she has self harm and MH issues but that wasn't what was put forward by the defence. Also, he apparently was the only one who witnessed the "paranormal" activity.

The whole story is very bizarre. The Prosecution clearly felt there was sufficient evidence to charge him with assault.

I have to say, if I was the lawyer for the defendant I would not be inclined to put a theory out there that the cause was demonic possession. I'd just emphasise the lack of evidence.

Though I guess maybe if the defendant really believes that, the lawyer thought the judge and jury would interpret what really was going on as something like self-harm.

alexdgr8 · 17/11/2020 03:00

haven't read the whole report.
was the defendant represented, or did he conduct his own defence.

EmmaGrundyForPM · 17/11/2020 06:10

He had a lawyer. The judge said the Prosecution should have looked more seriously into the defendants claim of demonic possession.

His girlfriend called the police after he shook her and had his hands round her neck causing bruising.

Nomnomarrgh · 17/11/2020 06:49

I fail to see how self harm leads to finger marks around her neck

Whatwouldscullydo · 17/11/2020 07:00

Poltergeist activity and demonic obsession re different things did he fall asleep in front of the exorcist and wake up half way through poltergeist ?

Like Rachel.ij friends and her shepherds pie/trifle...

Whatwouldscullydo · 17/11/2020 07:00

Possession...

Stupid auto correct

EmmaGrundyForPM · 17/11/2020 07:11

I know the defence has to.present the case as given to them by the defendant but this sounds bonkers.

He also sounds dodgy as f**k. He supposedly takes her to a clinic in.the US which is so top secret that he cant disclose the name.

Absolutely
Imnobody4 · 17/11/2020 09:51

I suppose if you believe humans can change sex you can easily believe in demonic possession and vice versa. The state of Ireland continues to shock me.

Whatwouldscullydo · 17/11/2020 10:11

Many are Catholic aren't they?

If you believe in God saints and heaven you kinda have to believe in the devil and demons too..

CatsCantCatchCriminals2 · 17/11/2020 10:29

We have misogynistic ghosts now?

EmmaGrundyForPM · 17/11/2020 18:38

Apparently so.
