Man who pierced holes in condoms is jailed for rape - court treating this more severely than "sex by deception"

I'm posting because it seems that although there have been some cases of "sex by deception" discussed on FWR I dont think any of them were convicted of rape.

But I may have misremembered and as far as the law is concerned and maybe there isn't actually any legal definition of "sex by deception".

Was happily surprised to see most comments agreed with the judgement.

It is frequently said on here that no method of contraception is 100% reliable and if men don't want to become fathers they shouldn't have penetrative sex.

But that’s not what you said. You talked about a sabotaged condom. No woman on here or any other thread has blamed a man if someone else has sabotaged his condom. Yes, he is also jointly responsible for the pregnancy if a condom fails and needs to share responsibility, but that’s different from a woman sabotaging one. You’re the poster conflating both situations.

I've just been reading a thread on dadsnet section by a poster whose wife deliberately stopped taking the pill because she wanted another child and he didn't.

Lots of the initial comments are by female posters criticising him for being lazy and not taking ownership of contraception. Certainly a point that can be argued (although in a trusting marriage the pill should arguably be enough) but I'm shocked that there seems to be a blindness to how similar it is to putting holes in a condom.

That’s a huge difference. I mean, I would not have anything to do with women who does this but poking holes is more than preventing pregnancy, it also suppose to prevent STD too.

Fair point but it's still 'sex by deception'. In this case 'fatherhood by deception' too. And of course we know the man now has no choice in whether he continues to financially support the child for the next 18 years.

@ManOfPies
Many men don't support their children and their is nothing to make them. Oh and before you say that the csa will as they are a complete joke i am owed over £50000 in back child support and now that my dd is over 18 they just closed the case. This happens all the time
