Who should search?

A person is brought into custody

This person, has a male body, is not taking hormones.

They have a female name and dress "as a woman" they say they are a female.

There pronouns are she, her ect

Who should search her?

A man because they are essentially male

A female because they are a transwoman

Also should a female be forced to search the above person, how do they decline without consequences?

I passed through airport security in Stockholm. They seem quite relaxed. I observed a man, dressed as a man, I guess identifying as a man (?) being searched pretty thoroughly by a blond, Swedish female security officer. He looked quite uncomfortable, so I would assume he hadn’t requested it....

If I was the female, I would say that I identify as a male, so don’t feel comfortable searching that person. Acceptance, without exceptions, after all. I would stand my ground and any accusations of transphobic behaviour, would result in me making a counter complaint that they were behaving in a transphobic manner against me.

If you say as a female, I'm not comfortable searching an obvious male, however they present. And your boss says tough luck get on with it. What can you do?

When you say 'her etc' what does this mean
I mean they use female pronouns

But I heard that the problem was solved for that trans woman? I think a beautician tweeted that provided that she came to her saloon and provided that a complete indemnity was signed, she would do an exact female Brazilian, using the normal female wax?

I think the indemnity for for severe bodily harm though...

It depends what your job is and even what part of the country you live it. Some police forces are so woke that female police officers are being told that the MUST search any male bodied person that claims to be trans, even if they have made no changes. It’s state sponsored sexual assaults on women.

It depends on the Gender Recognition Act and The Equality Act.

We don't have self ID in the UK, so how the person identifies is irrelevant. the first question is 'do they have a Gender Recognition Certificate'. Its not legal to ask to see it, but if they have one they also have an amended birth certificate which says 'female' and other ID which you can ask to see.

A man without a GRC (has a birth certificate that says 'male') is treated as a man for all purposes.
A transgender person with a GRC who is male but has a birth certificate that says 'female' is treated as their acquired sex for most purposes. There are exceptions where you can reasonably expect a space or service to be single sex.

If in your job its usual for women to woman to strip search men you might not be able to object, unless the man is a convicted sex offender and it could be considered demeaning or dangerous for you.

Refuse, and then talk to your union if you have one. You may get the sack but frankly I'd prefer that to being forced to fondle a stranger's ballsack when that was most definitely not what I'd signed up for when taking my job.

I have suffered sexual abuse and rape and would rather loose my job.

Me too, there is no job that I'd consider worth being forced to put up with that. At some point there's going to be a union test case for this, and when that happens we all need to throw our weight behind it because this is really important. If women have no right to refuse in situations like that then we basically all become unwilling providers of sexual services if we're in any job that potentially involved physical contact.

Sex is a protected characteristic, and single sex spaces and services are allowed as permitted exceptions in the Equality Act. Focus on your own rights because other people may try to muddy the waters.

You might approach your employer and ask them to clarify their position. Would they let a man, or a man who identifies as a woman perform a strip or internal search on a woman?
