Deed poll process needs 'attention' to ensure trans people are not being outed, says High Court judge

The process of changing your name by deed poll “needs close attention” to ensure that trans people are not being outed, a High Court judge has said.

Master Victoria McCloud says the process for changing a name by deed poll is "very public" because High Court staff publish old and new names on the internet via a notice in the London Gazette, the official newspaper of the Government.

She says the process can lead to people who have changed their name as a result of changing their gender being outed and has suggested that the issue should be drawn to the attention of a senior judge.

Master McCloud, who herself transitioned from male to female and changed her name, outlined her concerns in a ruling, which has been published online, relating to four people who had changed their names....

Its like every part of the decisions making arms of society have now been infiltrated by trans rights activists.

How do we keep up with what they are doing letting alone stopping them. Angry

@NiceGerbil

The opportunity for men who are criminals to exploit any changes are obvious.
Yes.

Is it a coincidence that the majority of 'rights' these TRAs are demanding just happen to blow massive holes in the safeguards we have in place?

I personally disagree with the article as deed polls don’t have to be publicly recorded in the London gazette. That’s only for enrolled deed polls which frankly aren’t necessary to change your name - the passport office accepts normal deed polls.

What's with all the zombie threads being bumped?

DidoLamenting · 04/09/2020 19:24

@ifIwerenotanandroid

But you don't have to do it this way. See:

www.deedpoll.org.uk/IsADeedPollRegisteredAnywhere.html

It appears that trans people, like anyone else, can change their name by deed poll & not enrol it so there's no publicity.

What's the problem, or have I misunderstood something?

That link says

Separated women need their husband’s written consent to revert to their maiden name (in fact, all married people and civil partners need their spouse or partner’s consent)

I'm sure that is not correct.

stumbledin · 04/09/2020 19:45

If the issue is still relevant it isn't a zombie thread.

What isn't necessary is for posters who aren't interested in a topic to come and posts messages implying that those who are posting are stupid for doing so.

The point of the article was that those who want to go for the more legally authoritative route for name changes have to do so by including a public notice about it. The Judge thought this wasn't fair on trans people. The Judge want the same annonymity for those chosing the "enrolled" version as the cheap one which does allow people to change their name without public notice.

That is all the article was about.

The enrolled version has more legal "status" but for many this may not ever be necessary, but was about ensuring people did name changes in "good faith" evidenced by the willingness to do this in public (rather than behind people's backs or for dubious purposes).

If you started and finished your law degree as a man, I don't think you qualify to get your picture up among 100 illustrious women lawyers. You just don't. I suspect those pictures will quietly disappear in a year or two, leaving pale patches to be filled by images of women who overcame the barriers put up to deter them because of their sex.

Let's have another space to celebrate transgender lawyers; they have a right to it.

Gottalife · 04/09/2020 21:28

@ifIwerenotanandroid

When I asked if I'd misunderstood, I meant is there any requirement for trans people to do their name change in a certain way, or can they choose. It seems they can choose, so what's the problem?
I thought a Statutory Declaration is good enough.

Separated women need their husband’s written consent to revert to their maiden name (in fact, all married people and civil partners need their spouse or partner’s consent)

Do they mean for children? In the UK you can literally call yourself what you want. We've even just used that UK deed poll service for our son, and it's been happily accepted by the passport office, and for residency permits in more than one country. No publishing necessary (and when I needed a copy, they DHLed one to a non-european country the same day - well 2 days to arrive).

I'd like to hear what the actual issue is with the standard, non-public way of changing your name.
