'The guidance warns that making jokes about a child who is not transgender but resembles or dresses like the opposite sex, could also trigger legal action. “A female pupil has short hair and wears stereotypically male clothing,” it suggests. “A supply teacher mistakenly assumes she is trans and jokes about this with another teacher outside the classroom. Some students hear this, causing embarrassment to the pupil in front of some of her classmates. This could amount to unlawful perception discrimination because of gender reassignment.”

Surely making fun of a pupil is always a bad thing. I'm not sure how this is a clear example that should be included in guidance about gender etc.

My dd used to be called a name that mocked her so-called gender presentation. Eg if her name was Annette she would have been called 'manette'.
But this was by people who identified as Trans. So nothing was done. I would prefer guidance that would help in those circumstances.

Does EHRC actually understand the equality act? This sounds exactly the same as the LGBTY Scotland guidance which was pulled as it was so problematic.

And it goes without saying that children who identify as trans should not be excluded from PE lessons Hmm

However, where activities or facilities are divided by sex they should use the activity/facility appropriate to their sex.

I have a girl in S4 and a boy in S1. I'll be reading those emails the headmaster is sending out a lot more carefully in future in case he mentions this guidance. There is no way my almost 15 year old daughter would use a bathroom if there could be a boy, however he identifies in there.
I didn't know Gilligan has left the ST.

David Isaac head of the board of the EHCR previously lead of Stonewall & is a prominent LGBT campaigner. No bias there then.
