@MenuPlant No you didn't give duff advice at all - you gave me a really useful reminder that there is something that each one of us can do and that only takes a couple of minutes

MrsBertBibby · 03/07/2019 16:59

It isn't clear that you can, though.

The unduly lenient sentence scheme applies to all offences triablevon indictment only. If this guy was charged under s20 of malicious wounding, as opposed to s18 wounding with intent, then it's an offence triable either way, therefore not necessarily inside the scheme.

By all means refer, but the attorney general may be powerless at refer.

GroggyLegs · 03/07/2019 17:14

unfortunately he was the victim of a massive nationwide scam where he lost £100,000. His family are reasonably well off and we're able to assist on their part but he did have an alcohol and gambling addiction
Sadly the effect of that was somebody else's life has been affected in the way it has

I know it's his job, but how does someone say this and sleep at night? It's so... mealy.

I mean, he couldn't possibly be held fully accountable for his own disgusting actions, could he? It was the con artists fault m'lord, even though his mum & dad gave him a wedge to soothe the pain he just couldn't help himself.

Angry
PerkingFaintly · 03/07/2019 17:22

That's a good word for it, GroggyLegs.

MinesaBottle · 03/07/2019 17:26

I find it especially sinister that he took her phone away and locked himself in a room with it so she couldn’t phone for help. That’s very clear-minded for someone who was supposedly so drunk.

Kilbranan · 03/07/2019 17:29

This was surely attempted murder - he stamped on her chest and neck and then took her phone away! She could have easily died. What a scumbag Angry

ChardonnaysPrettySister · 03/07/2019 17:31

Three years?

What kind of sentencing is this?

SimplySteveRedux · 03/07/2019 17:36

This. Thanks for the AG info, have emailed.

GroggyLegs · 03/07/2019 17:55

Can I ask what you include in the email to the attorney general email please?

I want to send one, but unsure where to start.

Is it literally 'please review this sentence as I feel it's too lenient' or do I need to be technical & refer to other cases with more fitting sentences?

misscockerspaniel · 03/07/2019 19:55

GroggyLegs All I did was name the man involved, refer to the newspaper article (I attached a link), mentioned that I didn't know the people involved and said that on the basis of the info in the article that the sentence appeared to be lenient, and asked if it could be reviewed. I don't know if they will but I couldn't not do anything - this case is appalling.

MoltenLasagne · 03/07/2019 20:13

I assume part of the reason for the sentence’s leniency is because the CPS chose to prosecute a lighter (and supposedly easier to convict) charge.

Is there a similar request to review for this decision? It seems appalling that in such a clear cut case where the attacker deliberately took away the woman’s ability to get help he wasn’t tried for attempted murder.

Why are the CPS consistently dragging their heels in prosecuting all forms of VAWG? They seem to go for the lesser charge whether it’s attempted murder, actual murder and rape.

Earlywalker · 03/07/2019 20:19

How horrifying. That poor woman.
3 years?!
He took away her phone, leaving her to die how is that not attempted murder?

Hecateh · 03/07/2019 21:26

His family have money and lots of it

I think in cases like this it says it all.

Family legal team - 'We know he's been a bad boy and we will accept xxx - try to prosecute for anything more and we will throw millions at it'

Can't think of any other possible reason

GroggyLegs · 03/07/2019 21:57

That's appalling Hecateh
More so because it's a very plausable theory.

Thank you misscockerspaniel

JessicaWakefieldSV · 04/07/2019 13:05

Compare it to this sentencing, also horrible crime but the same sentence?

www.dailymail.co.uk/news/article-7212799/Teenager-tortured-ex-boyfriend-jailed-three-years.html

Italiangreyhound · 04/07/2019 18:46

I think three years is too lenient for that crime too! Bit o think what this bastatd man did yo his partner is in a whole mother league. I believe it is true in law that when a man hurts a female partner the law somehow assumes it is less of a crime than a stranger hurting a male. So if he had done this to a man in the street, what would the penalty be in law?

Italiangreyhound · 04/07/2019 18:52

Looks like xpuld be 3-16 years for assault but GBH could be up to life imprisonment? Why is what he did not GBH?

He could be put in s couple of years demanding to see his child!

ChattyLion · 04/07/2019 19:10

How the fuck is this not attempted murder?

Italiangreyhound · 04/07/2019 23:38

Does anyone have the email address for making complaints about this leniency, please?

Italiangreyhound · 04/07/2019 23:39

I cannot see how his is not attempted murder.

"Afterwards as she lay seriously injured on the ground, Swarmy took her mobile phone and locked himself in a room at the couple's home to stop her calling 999 for help."

Italiangreyhound · 05/07/2019 00:12

Ah, found it. www.gov.uk/ask-crown-court-sentence-review

No idea if they will review but if not, if it is not one of their categories I think we should pressure for this to be included in the categories that can be reviewed.

Childrenofthestones · 05/07/2019 06:38

We're long past the point where we need a review of our sentencing policy on violent crime.
