Female swim team banned from staying in North Carolina, by NY governor, because of North Carolina trans bathroom law

12 swimmers/divers (11 female, 1 male), from the State University of New York are due to compete at the NCAA national championships in North Carolina.

But the Governor of New York, Andrew Cuomo has banned publicly funded travel to North Carolina because of North Carolina's transgender bathroom law.

So they raised the money themselves.

But Cuomo has banned that as well, and said that

(a) they are not allowed to fly to North Carolina, they must fly to Virginia
(b) they are not allowed to stay in North Carolina, even if they pay for it themselves, they must stay in Virginia, and spend several hours a day commuting to the venue

Forbidding internal travel within the US is flat-out unconstitutional. It's right there in the original document.

I hope this goes to federal court ASAP.

NC says birth sex is permanent and cannot be changed.

NY says anyone can use whichever bathrooms they feel like according to their 'gender identity,' whatever the fork that is.

It isn't a female swim team if one of them is male.

I would have thought so long as the one male member agreed to abide by the laws in using the male accommodation, that should be fine so no need to ban them?

It’s not about them being banned. The powers that be in New York are insisting that sex-based segregation is prejudiced and therefore they will not allow these athletes to go and spend their money in a bigoted state.

That's a crap decision - whichever side of the debate you are on - those swimmers have lost this opportunity because of political decisions beyond their control.

Anyway, bathroom use should be based on biological sex, which is immutable.

I'm confused. The NY governer is telling the women's swim team they can't stay in NC because the trans swimmer wouldn't be able to use the women's changing rooms? How can they stop them if they're using their own money?

I think because it's a NY State school - and a school team. But I think it's a very dicey decision, and as a pp said, unconstitutional.

No, to be clear, they have separate male and female swim teams, and it affects both teams equally, however in terms of participation there are more females than males, and in terms of achieving elite status, it's even more disproportionately female.

Indirect sex discrimination, in this context.

The swim team is 11 biological females and 1 biological male, and none of these parties are confused about that.

The issue is NC HB2 - North Carolina passed a law prohibiting biological males from entering toilets designated for biological females. In addition, the law banned NC cities from passing their own laws intended to regulate this. The former was repealed after lots of.big companies complained, but the latter was not.

So there is now no statewide ban on biological males in female bathrooms, but there IS a ban preventing, say, the city of Charlotte from passing a law saying that biological males DO have the right to use these bathrooms.

This has been deemed discriminatory by California, NY and others, and they have punitive bans on state travel to NC

Freedom of movement by citizens between states was bedrock principle in the founding of the country. I’d really like to this challenged in court.

Though, on the other hand, I do also eagerly await the day California, NY, or any other state, corporation, sports team, or performer boycotts Texas, Arkansas, Mississippi, Missouri, Kansas, Oklahoma, Alabama, North Dakota, South Dakota, Ohio, Indiana, Tennessee, etc. who continue to enact laws constructing women’s reproductive rights.

I expect I’ll be waiting a very long time.

Are any of the more 'progressive' states doing anything similar to put pressure on the ones restricting women's reproductive rights?

So many states pursue bizarre policies, such as refusing:
to fund opioid overuse disorder programmes properly,;
to implement parts of Medicaid eligibility that would assist a wider range of people and be very helpful in a pandemic.

Quite. It's astonishing to see the grandstanding items that grab attention ahead of all others.

And, yes, it is distressing for the young people affected by the ban. Politicians are adept at grandstanding with other people's opportunities.

Indeed. Some of the Medicaid state laws had dire health consequences for people and other state laws that were laxer about COVID has contributed to death and sickness. Of all the things to protest, they choose the bathroom bill nonsense.
