WASHINGTON — The Trump administration is considering narrowly defining gender as a biological, immutable condition determined by genitalia at birth, the most drastic move yet in a governmentwide effort to roll back recognition and protections of transgender people under federal civil rights law.

A series of decisions by the Obama administration loosened the legal concept of sex in federal programs, including in education and health care, recognizing sex largely as an individual’s choice — and prompting fights over bathrooms, dormitories, single-sex programs and other arenas where gender was once seen as a simple concept. Conservatives, especially evangelical Christians, were incensed.

Now the Department of Health and Human Services is spearheading an effort to establish a legal definition of sex under Title IX, the federal civil rights law that bans gender discrimination in education programs that receive government financial assistance, according to a memo obtained by The New York Times.

The department argued in its memo that key government agencies needed to adopt an explicit and uniform definition of gender as determined “on a biological basis that is clear, grounded in science, objective and administrable.” The agency’s proposed definition would define sex as either male or female, unchangeable, and determined by the genitals that a person is born with, according to a draft reviewed by The Times. Any dispute about one’s sex would have to be clarified using genetic testing.

Feminists sued the government to reverse Obama's title IX atrocities - but hey, let's wait what a man (Trump) has to say, and sort out our opinion in response to that.

Now, why would that be that you expect women to adapt their positions to what some man says?

This is very good news and should be supported. It is essential that sex is defined clearly in law, in every country, and that women and girls are the female sex and are recognised as such. I think the suggestion to make discrimination on the grounds of presentation sounds OK in theory (it would protect women who didn't want to wear high heels etc), but I am not really sure about getting anything to do with 'gender' enshrined in law. I think the word 'gender' should be ditched, quite frankly. It is confusing, means the opposite to different people. Also, you could see it being abused and employers hating it (slobs not dressing smartly and professionally for work). I'm just very happy with sex being clearly defined in law.

"A male physical-education teacher in a Florida school district has been told he will be transferred to another school as discipline for not doing his job.

Chasco Middle School in Land O’ Lakes, Florida, has drawn the attention of the non-profit legal group Liberty Counsel for adopting the transgender activist agenda.

Mat Staver, founder and chairman of Liberty Counsel, said the Pasco County School Board must “reign in these rogue school employees and administrators and reject their unauthorized LGBT policies and practices that violate parental and employee rights and the privacy rights of students.”

Liberty Counsel has written a letter to Cynthia Armstrong, chairman of the Pasco County School District Board, in response to an unwritten “policy” that allowed a girl to use the boys bathroom and required “others to refer to her with false gender pronouns ‘he’ and ‘him.’

Liberty Counsel said the school’s two P.E. teachers, identified as Robert O. and Stephanie C., objected to administrators’ orders “to allow the girl into the bathroom, with no forewarning of the boys, or their parents, so that the boys could take steps to protect their privacy.”

“Administrators told them that informing the boys so they could take steps to protect their privacy would be ‘discriminatory,’ and subject them to discipline,” Liberty Counsel said.

“Robert also objected to administrators’ orders that he continue to walk into and supervise the locker room, despite a girl potentially being nude or undressed in that area. The administrators told him that the girl in question had ‘every right to use the locker room,’ including the right to disrobe in the open locker area, and shower in its open showers, where Robert is required to periodically walk in and supervise.”

Liberty Counsel declared to the district that Robert “will not knowingly place himself in a position to observe a minor female in the nude or otherwise in a state of undress.”

“Now, Robert has been told by administrators that he will be transferred to another school as discipline for ‘not doing your job in the locker room." (continues)

Teenagers are not good at understanding their own boundaries or those of others. Thank goodness these grown men understand this. The idea of a PE teacher being put in this position - and possibly getting an involuntary erection - is really horrible.

On Sunday, The New York Times dropped a bombshell, reporting that the Trump administration was considering draft rules to reverse Obama's move redefining "sex" as "gender identity" in federal law. Radical feminists eviscerated the report on Monday, even as liberal activist groups and transgender activists took to the streets to protest the tentative rule change.

"The Women's Liberation Front (WoLF) is a radical feminist organization that stands to liberate women and girls from patriarchy," WoLF lawyer and spokeswoman Kara Dansky told PJ Media on Monday. "You can't fight for the rights of women and girls if you can't define that category directly."

"Women have been oppressed and discriminated against for thousands of years on the basis of our biology," not their gender identity, Dansky declared. "Everybody knew what a woman was when they wouldn't let us vote."

The radical feminists at WoLF actually sued the Obama administration over its legal redefinition of "sex" to include "gender identity" in federal civil rights law. This move "effectively strips women and girls of their legal protections by eliminating the ability to legally distinguish between males and females," WoLF explained. The group dropped the suit following news that the Trump administration would not follow the same rules.

"The NYT piece misleads its readers by suggesting that it is possible to change sex, and it uses the words 'sex' and 'gender' interchangeably," Dansky told PJ Media. Echoing the Obama administration, The New York Times adopted the language of transgender ideology, which makes it more difficult to protect women.

Dansky also attacked the Times story for suggesting "that it's only conservatives who object to the erosion of female-only spaces and the rights and privacy of women — we are a radical feminist organization that fights for the rights and privacy of women, including our right to complete reproductive sovereignty; we are hardly a conservative organization."

Miriam Ben-Shalom, the first open lesbian to be reinstated to the U.S. Army after being dismissed for her sexuality, also criticized the Times story, defending Trump's proposed change.

"I simply am not able to understand how it has come to be that we do not 'know the difference between SEX (which is biological) and GENDER, which is an artificial construct of a society which deals with the behaviors of that society — based on the SEX of the members of that society,'" Ben-Shalom, who has also described herself as a radical feminist, told PJ Media on Monday."

She attacked the transgender ideology as "fake science."

Ben-Shalom condemned the transgender movement for using intersex persons who suffer from "genital or genetic anomalies" as an excuse to deny the biological gender binary of humanity. "Intersex people do not like being used this way and the fake science being bandied about by transgender-identifying people and their allies is ludicrous, unreasonable, and unsuitable," she declared. The Sean Collins piece in Spiked is written so clearly; seems a good one to share to explain the legal situation in the US. He writes,

As it happens, if anyone wants to extend anti-discrimination law to include gender identity, that's their prerogative, but they should seek to pass a new law, not edge in on an existing law designed to protect women. Of course, that would require transgender advocates to wage a campaign to convince the public and elected representatives -- something that the pro-trans 'movement' has not done to date. Indeed, this cause has been a thoroughly top-down initiative...

This story is, as Trump would say, FAKE NEWS.

The facts are these:

  • Title IX was a Bill with bipartisan support passed in 1972 to protect women from discrimination in education, including school sports, and all other federally-funded programs, on the grounds of SEX
  • Some shit-for-brains woke fools in the Obama administration decided to unilaterally redefine 'sex' as meaning gender, which would therefore discriminate AGAINST those of the female sex in favour of those of the male sex under transgender identity. This was done without public consultation or legislation passed by elected officials, it was done simply by executive order.
  • Trump rightly repealed this nonsensical dictat and is replacing it with one that complies with the intent of the members of Congress in 1972.

However this under FAKE NEWS is described as ' Defining Transgender Out of Existence'.

Clearly it's not. It's merely cancelling the 'Defining Sex Out of Existence'.

All I can say is fuck the people who think this kind of journalism is acceptable. It's no wonder the culture war has intensified.

Starts with the powerful testimony of a rape/CSA survivor who lost her job for objecting to the implementation of "gender-inclusive" changing rooms at her workplace. The other panelists include a radfem lesbian, a midwife, and conservative Christians. Absolutely fascinating to see them setting aside their other differences in a mutually respectful way, in order to work together to defend women and girls.
