Well done to the woman for pursuing this. Maybe we will see more of these kinds of actions resulting in men being more careful about getting consent

Well done her.

Given all that evidence that she was incapable of consent, why did they not have a guilty verdict in the first place?

QuentinWinters · 15/10/2018 12:03

I'm guessing because despite the guidance, jurors still believe that women can reasonably consent when to drunk to do anything else, like open their front door.

It was tried in a Scottish court, and the verdict was "Not Proven". The jury did NOT say he was innocent. A Not Proven is more akin to 'we think you did it but the evidence isn't strong enough'.

4 adult male witnesses (not actually taking part) were not present?

Good for her. I hope more victims do this as the 'normal' trials for rape are fucking ridiculous generally. I mean, the Ulster case that I followed a few months back was insane, there was a lot of proof, the guys contradicted each other in many places..and still they were let off. Too many people/jurors believe rape myths.

A side point is that I hate how not proven is generally reported on, especially by the BBC. They always say it means the person was found not guilty which isn't the case. I always complain when I see that
