Man “with no penis” sexually assaults women. However the perpetrator was actually born female. I can’t really get my head around it all.

I’m still new to this whole subject and maybe some more coherent thoughts from others with more knowledge/experience would help me get my head around it.

Won’t the victims feel they were assaulted by a lesbian woman? If it were me I’m not sure I’d want it to be reported that a man assaulted me.

So, I'm guessing it can't technically be 'rape' without a penis as I believe the legal definition applies only to men. Personally, however, I would feel raped had I been forcefully penetrated with a prosthetic penis.

I also wonder if transmen commit more sexual offences than natal women? It's not something I've ever seen discussed as the focus seems to be overwhelmingly focused don transwomen.

It is a case in Scotland, which has a different legal system to England & Wales, so I suppose they may have a different view on what equipment you need to commit rape. I'm sure one of our Scots lawyers will clarify. The link does say 'sexual assault' which is what penetration with an object would be called in England & Wales, so presumably Scotland too. I recall reading about it earlier: an odd case. But I'm sure we'll be hearing of more odd cases in the future, now we are having 'transbians' et al.

The Sexual Offences Scotland Act 2009 refer's to "person A" "person B" not his or her. Rape can be effected by a prosthetic penis if it is a surgically constructed penis if it forms part of A, having been created in the course of surgical treatment.

From the description of his holding on to it this suggests it wasn't surgically constructed. In which case the prosecution presumably used section 2 of the Act- sexual assault by penetration.
